Norwegian Production of Visors for the Health Authorities and Municipalities in Norway in Relation to Covid-19
Accelerated procurement for the purchase of visors from Norwegian tenderers.
Purchase of 600 000 visors for use in the pubic health service (hospitals and municipalities).
Afdeling IV: Procedure
A new negotiated procedure is being used without a prior notice, in accordance with PPR § 13-3 letter e. The market of relevant tenderers in Norway has been mapped and an invitation has been sent to all relevant tenderers that had previously registered their interest in producing visors in Norway.
As a result of Covid-19, a precarious situation and major lack of infection prevention equipment in Norway. Based on challenges with getting critical products for infection prevention into the country, it has been decided from a political standpoint that a certain degree of production of such products in the country should be stimulated. The current framework agreement supplier does not have the possibility of covering the need.
The legal departing of Sykehusinnkjøp HF [the Norwegian Hospital Procurement Trust] has concluded that new contracts for new and escalated production in this category in Norway can be carried out as an accelerated procurement in accordance with the procurement regulations (PPR) § 13-3 e), since it is considered ‘impossible’ to implement ordinary competition due to the time aspect. This is supported by Nærings- og fiskeridepartementet [the Ministry of Trade, Industry and Fisheries], and it is repeated in their article concerning the COVID-19 outbreak and procurement regulations.
Nærings- og fiskeridepartementet’s [[the Ministry of Trade, Industry and Fisheries’] assessment that the purchasing need resulting from the outbreak of a pandemic can give the basis to use the procedure form ‘competition with negotiation without a prior notice'.
The basis for applying the provision is that any delay in the procurement can be detrimental to human life and health. This condition has undoubtedly be fulfilled in the situation we have been in, with a major deficit of infection prevention equipment, including eye protection.

The stated contract value in relation to the individual contract is the total value for all contracts combined. Disclosure of the value of the individual contract is exempt from publicity in accordance with PPR § 21-6 (4) letter c. By disclosing the value of the individual contract it will be easy to calculate unit prices, which is considered confidential information and thus can be exempt from public disclosure in accordance with the Public Administration Act § 13, first paragraph, No 2.
