Description of the economic or technical reasons and the inconvenience or duplication of cost preventing a change of contractor:

Vertraglich hatte der AN-Bau vorgesehen, eine straßengebundene Technik für die Logistik seiner HLV-Leistungen vorgesehen. Dies ist Bestandteil des Vertrages mit dem AN-Bau. Aus bauablauftechnischen Gründen infolge mehrerer zeitgleich stattgefundener Baumaßnahmen konnte der AG dem AN-Bau die vertraglich vorgesehene Logistik nicht gewährleisten, so dass eine gleisgebundene Logistik auszuführen war. Infolge dieser Umorganisation wurden zudem zusätzliche Vorleistungen erforderlich, die durch den AN-Bau ausgeführt werden mussten. Die den gegenständlichen Leistungen zugrunde liegende Logistik sind Bestandteil der vertraglich mit dem AN-Bau vereinbarten Leistungen. Ein Wechsel zu einem anderen AN-Bau hätte mind. eine Teilkündigung des beauftragten AN-Baus bedeutet, was negative wirtschaftliche Auswirkungen für den AG bedeuten hätten.
