VII.2)Information about modifications
VII.2.1)Description of the modifications
Nature and extent of the modifications (with indication of possible earlier changes to the contract):

The modifications will require a further extension of the contract by 18 months (in addition to the initial extension of the contract by 24 months, pursuant to the provision for such extension in the original contract, which had a term of 60 months from the full start date of the provision of the services, following a short transition period).

Accordingly, the following sections of the contract shall be amended:

— term (to be extended by 18 months, to terminate on 28.2.2021 unless terminated earlier in accordance with the contract),

— charges (to be amended to reflect a decrease in the value of variable charges, and an increase in the charges for professional services, each with effect from the date of variation).

VII.2.2)Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

The need for modification is brought as the contracting authority intends to migrate its information technology services and capability to operate via the cloud and has encountered a number of unforeseen delays beyond the Contracting Authority's control in the process of migration, which it could not diligently have foreseen at the time of the award of the contract. Having forecast at the time of the award of the contract that the Contracting Authority would have substantially different needs on the scheduled termination of this contract following a successful migration to the cloud, the Contracting Authority now finds itself in need of an extension to this contract, with a view to procuring appropriately revised services on the expiration of the amended terms of the contract. The Contracting Authority intends to post a future opportunity notice on contracts finder in relation to such future procurement in mid July 2019.
