In the context of systematic demographic management, the BVG has successfully implemented a number of measures in recent years, as an essential component of sustainable business development. In addition to existing demography management measures, further measures will be designed and implemented on the basis of the collective agreement on demography (TV-demography). In particular, we want to invest in the promotion of the health of our employees and create an additional service that will specifically help to ensure employability and strengthen the promotion of health – in addition to the existing activities of occupational health management. BVG therefore wishes to offer its employees the possibility of bike leasing.

A corresponding offer of two-wheelers will be made available via a bike leasing portal. The operator of this portal is expected to carry out the entire leasing process through a leasing bank. Handling should be kept as simple as possible for the BVG employee.

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

For the aptitude test, the tenderer/candidate must prove his/her skills, efficiency and reliability for himself/herself and, where appropriate, for subcontractors.

Proof of suitability may be either:

—by entry in the ULV-Berlin and, in addition, by presentation of the form ‘self-declaration of suitability’, variant 2;

—by entering the pre-qualification database for supplies and services and, in addition, by submitting the form entitled ‘Own declaration of suitability, variant 3’;

For tenderers/candidates who have not been entered in the above-mentioned databases, the form entitled ‘Own declaration of suitability, variant 1’ must be provided.

The form (self-declarations of suitability; Variant 1-3) is attached to the tender documents.

At the request of the contracting authority, self-declarations must be certified by certificates issued by the competent bodies.

Ö 1. This notice starts the competition (TNW) in which the interested undertakings apply for the invitation to tender with the information, declarations and evidence set out in this notice – ‘No tender’. Only a successful application with a positive aptitude test and assessment by the AG will lead to the invitation to tender.

Ö 2. Questions for candidates must be sent using only the functionality of the allocation platform (see point I.3.), indicating the name of the measure (see point II.1.1.) and the reference number. Information will, in principle, only be provided on questions received by the body referred to in point I.1., using the functionality of the procurement platform (see point I.3.). Until the closing date for the submission of tenders, the candidate is required to pay regular and independent attention to documents provided, modified or additional.

The contracting authority shall not indicate it separately.

Questions from tenderers must be submitted by 10/7/2020 at the latest.

Tenders from unsuitable candidates will not be considered.

At the end of the contest, it is not possible to qualify or participate in price negotiations at a later stage during the contract period. Any requests for amendments to the contract must be notified to the BVG together with the tender.

Award of the contract:

The submission of all documents, confirmations and supporting documents by the deadline is an essential condition for further evaluation.

The specific award criteria are set out in the tender documents.

In the case of the award of public contracts, and in accordance with the applicable procurement law provisions, the provisions of Sections 1, 7 and 8 of Berliner Vergabe- und Vergabegesetz (Berliner Vergabe- und Vergabegesetz) provide tenders which comply with and are otherwise of equivalent value.

Companies prefer the bonus which provides apprenticeship places, participate in pay-as-you-go schemes to secure initial vocational training or training groupings. As evidence, tenderers eligible for the contract must have a certificate from the body responsible for vocational training.

The suitability of subcontractors who have not yet been identified in the request to participate but whose use is planned from the start of the work is based on the tender submitted in point III.1.1. —III.1.3. selection criteria.

In the case of submission of a tender, the tenderer must:

A wage and minimum wage declaration within the meaning of § 1 BerlAVG for the tenderer and its subcontractors;

A declaration on the promotion of women in accordance with § 9 BerlAVG. Section 1 of the Regulation on the promotion of women in Berlin (FFV);

—the form details of intended subcontractors;

—Proposal for the assessment of the points listed in the award criteria must be provided.

The relevant declarations are attached to the tender documents.

The three best ranked bidders according to the published scoreboard will be invited to possible negotiation talks.

The possible negotiations are expected to take place between 3/8/2020 and 14/8/2020.

At the end of the negotiations, the remaining bidders may be asked to submit their last binding offers. These will then be evaluated by the Contracting Authority from an economic point of view (see evaluation/award criteria).

However, the BVG reserves the right to award the contract without negotiation.

ARTICLE 160 GWB (LAW ON RESTRICTIONS ON COMPETITION)

(1) The Public Procurement Board shall initiate a review procedure only on application.

(2) Any undertaking having an interest in the public contract or the concession and claiming an infringement of its rights under Paragraph 97(6) by failure to comply with public procurement rules is entitled to apply. It must be shown that the alleged infringement of the procurement rules has caused or threatens to cause damage to the undertaking.

(3) The application shall be inadmissible in so far as:

(1) the applicant has established the alleged infringement of the procurement rules prior to the submission of the application for review and has not complained to the contracting authority within ten calendar days; the expiry of the period referred to in Section 134(2) shall remain unaffected:

Infringements of the rules on the award of contracts which are apparent from the contract notice are not complained of to the contracting authority by the expiry of the time-limit for submitting an application or a tender specified in the contract notice;

Infringements of procurement rules which can only be identified in the procurement documents are not complained of to the contracting authority at the latest by the deadline for submission of applications or tenders;

(4) more than 15 calendar days have elapsed from the date of receipt of the contracting authority’s notification that it does not intend to remedy a complaint.

Sentence 1 shall not apply in the case of an application for a declaration that the contract is invalid pursuant to Section 135(1)(2). The sentence of Section 134(1) shall remain unaffected.
