Objective criteria for choosing the limited number of candidates:

In the event that the examination of requests for participation shows that more than 3 candidates or consortia meet the conditions for participation, the contracting authority will use the following selection procedure to select the 3 to 5 candidates invited to submit a tender.

The selection shall be made in accordance with a ranking which shall be established on the basis of a points score of the requests to participate. In this case, a maximum of 100 points per request to participate can be obtained, with the points rounded to the first decimal place. If the total number of points is equal, the selection will be made on the basis of the points obtained with the references. If this criterion is identical, the drawing of the lot will eventually be decided by the drawing of lots.

The distribution of points is as follows:

III.1)Conditions for participation

List and brief description of conditions:

The request to participate must be submitted, by the candidate or by each member of a candidate community, as follows:

Presentation of a current extract (not older than 3 months at the date of submission of the request to participate) from the trade register or professional register (register of crafts, register of the Chamber of Handicrafts, register of the CCI) of the registered office or place of residence of the applicant or of the candidate community; an up-to-date certificate from the trade or professional register of their country of origin shall be provided for candidates or members of a group not established in the Federal Republic of Germany.

If, in order to prove his/her economic and financial or technical and professional capacity to perform the contract for the performance of this contract, a candidate or a candidate association wishes to rely on the capacities of another undertaking (performance bond), he or she must also submit the request to participate in this respect, in so far as this company is concerned.

III.1.2)Economic and financial standing
List and brief description of selection criteria:

The request to participate shall be accompanied by the following documentary evidence by the candidate or by each member of a candidate community:

1) the self-declaration of the total turnover of the works in relation to each of the last financial years for which the accounts have been closed for the last financial year for which the accounts

2) evidence of professional risk indemnity insurance, or, alternatively, a binding declaration from the third party insurer that an already existing liability insurance in the case of a contract increases the minimum amounts of cover required below or concludes a feature insurance with the required minimum amounts of cover.

Where a candidate or a group of applicants is called on to prove the economic and financial capacity of another undertaking (performance bond), the above statement relating to paragraph 1) and the evidence referred to in point 2 above must also be provided for this company.

Minimum level(s) of standards possibly required:

1) The average annual turnover of the works, calculated on the basis of the last financial years for which the accounts have been closed for the last 3 financial years, must not be less than EUR 20 000 000. Where a candidate or consortium applies at the same time as Lot 1 and Lot 2, the average annual turnover established on the basis of the last 3 financial years for which accounts have been closed shall not be less than EUR 40 000 000. The average annual minimum turnover for works may be jointly provided by all members in the case of a group of candidates. Where the capacity of another undertaking is used to demonstrate economic and financial capacity, it is sufficient for the minimum annual turnover to be equal to the turnover of that undertaking.

2. the coverage of the professional indemnity insurance shall be at least EUR 3 000 000 per claim for personal injury and at least EUR 3 000 000 per claim for other damage.

Non-compliance with the minimum requirements will lead to disqualification.

III.1.3)Technical and professional ability
List and brief description of selection criteria:

With the request to participate, a maximum of 5 reference projects for bridge (lot 1) or tunnel projects (lot 2), completed within the last 15 years (2019 to 2005) or still in the process of construction, must be submitted by the applicant or the candidate community.

For each reference project for Lot 1, at least the following information shall be provided: Name of the reference holder, project name, name of the contracting entity, date of completion of the project or performance (if project not completed yet), description/presentation of the bridge structure from at least the following project information: Railway, light rail or tram bridge (yes/no), multi-fellow-steel coating (yes/no), total length between the back up, maximum span, timing (yes/no), deep formation with drill piles (yes/no), curved (yes/no) and number of tracks or lanes.

For each reference project for Lot 2, at least the following information shall be provided: Name of the reference holder, project name, name of the contracting authority, date of completion of the project or performance level (if project not completed yet), description/presentation of the tunnel construction work from at least the following project information: Railway or metro tunnel (yes/no), underground tunnel (yes/no), including underground station (yes/no), length of tunnel structure and open construction (yes/no).

In addition, for lot 1, reference documentation for road construction, track construction and contact line construction and for lot 2 are to be provided for road construction reference documents. The reference evidence may be based either on the aforementioned bridge/tunnel references or on independent additional reference documents. Such reference records shall contain at least the following information: Name of the reference holder, name of the project, name of the contracting authority, date of completion of the project, brief description of the road construction, track construction or overhead contact line construction measures provided, as a minimum: Surface area of road construction services (applicable to lot 1 and 2), length of track construction and contact line measures (applicable only for lot 1). These references are not used in the assessment of points under point II.2.9) but merely as proof of the minimum requirements.

Where a candidate or a consortium relies on the capacity of another company to demonstrate technical and professional capacity (performance bond), the relevant claims must be submitted for this company. The requested information must be provided once, in the case of a request to participate from a candidate community, only once per candidate community and not per candidate community.

Minimum level(s) of standards possibly required:

Minimum standards required for lot 1:

— To demonstrate that, within the last 5 years (15 to 2019), within the last 2005 years (50 to), a railway, light rail or tram bridge accumulated in at least one reference project has been completed in a cumulative way with steel structures above a multi-field construction with a total length of over m in length.

— To demonstrate, on the basis of reference documents, that the applicant has the necessary expertise and experience in the field of road construction, construction of tracks and running line structures. To this end, it must be demonstrated that, within the last 15 years (2019 to 2005), in at least one reference project, road works are carried out on an area of at least 10 000 m;2In at least one reference project have been completed on a length of at least 500 m and in at least one reference project track construction services at least 500 m long. Proof of the reference documents can be made on the basis of one or more projects.

Minimum standards required for lot 2:

— On the basis of the maximum of 5 reference projects, it must be demonstrated that within the last 15 years (2019 to 2005), an underground railway or metro tunnel construction area of at least 100 m in length was completed in open construction in at least one reference project,

— demonstrate that the applicant has the necessary expertise and experience in the field of road construction, using reference documentation. To this end, it must be demonstrated that, within the last 15 years (2019 to 2005), in at least one reference project, road works are carried out on an area of at least 10 000 m;2 have been completed.

Non-compliance with the minimum requirements will lead to disqualification.

III.1.4)Objective rules and criteria for participation
List and brief description of rules and criteria:

In addition to the conditions and criteria listed under points III.1.1) to III.1.3), the application for participation shall be accompanied by evidence of the absence of mandatory and optional exclusion grounds, as laid down in § § 123 and 124 GWB, by each candidate/candidate community by submitting self-declarations. To this end, use shall be made of the corresponding forms of the contracting authority which can be found on the website referred to in point I.3). The corresponding self-declarations are also to be submitted by the companies concerned, in the case of the suitability loan with the request to participate. In the case of envisaged subcontractors (no loan), the self-declarations are to be submitted prior to the award of the contract following a separate request from the contracting authority.

The other rules and criteria for participation are given in point II.2.9 and VI.3 above.

The request to participate must be submitted in German. For foreign language certificates, a translation into German shall be provided.

Applications must be submitted with the contracting authority’s application files (forms) which can be purchased by means of the e-mail address referred to in point I.3 above, free of charge.

If evidence or declarations are missing in a request to participate, the contracting authority reserves the right to request the missing supporting documents or explanations by setting a deadline. If the missing proofs and explanations are not submitted within this deadline, the request to participate will be rejected. The time limit shall start to run on the day following dispatch of the invitation by the contracting authority.

Furthermore, the contracting authority reserves the right to request documentary evidence of the self-declarations.

A candidate community with its request to participate has to make a declaration (form from the contracting authority), signed by all its members, stating all the members, an authorised representative as a contact point and stating that the authorised representative will represent the member of the group in a legally binding manner.

Tenderers or consortia must submit a declaration (form to be submitted by the contracting authority), together with the initial offers, whether they intend to cooperate with other undertakings in relation to the contract (sub-delegation). In this case, the nature and extent of the services to be provided by other undertakings must be specified. It is not necessary to identify the specific undertakings for the services concerned. Instead, the entities designated for subcontracting must only be designated and proof of the availability of the funds claimed must be provided if the contracting authority expressly so requests before awarding the contract.

If, in order to prove his/her economic and financial or technical and professional capacity to perform the present contract, a candidate or group of candidates wishes to rely on the capacities of another company to perform this contract (selection board), he/she must already indicate with the request to participate that the undertaking concerned must already be identified and demonstrated that the funds used are actually available to him/her. According to § 135 (2) GWB, the period for claiming the invalidity of a contract with a review procedure shall end 30 calendar days from the day of knowledge of the infringement, which results in the ineffectiveness of the contract but no later than 6 months after the conclusion of the contract or, in the case of publication of the contract notice in the Supplement to the Official Journal of the European Union, 30 calendar days after publication.
