The subject matter of the contract is provision of technical secretariat services for notified bodies group for Directive 2010/35/EU of the European Parliament and of the Council of 16 June 2010 on transportable pressure equipment (TPED NBG). Directive 2010/35/EU establishes a fully free market for the placing on the market and use of transportable pressure equipment. However, the Directive covers gases transported under pressure and an arrangement for the exchange of experience between member states is provided for with regard to notification policy and market surveillance. In order to ensure a level playing field, cooperation of notified bodies within the Directive 2010/35/EU is a key element in the correct application of the legal instrument across the EU and in the associated member states. Specialised expertise in the field of transportable pressure equipment and Directive 2008/68/EC (ADR, RID and ADN) is needed.

II.2.4)Description of the procurement:

Provide the technical secretariat for the group of the notified bodies under Directive 2010/35/EU for enhancement of the cooperation within that body. Directive 2010/35/EU establishes a fully free market for the placing on the market and use of transportable pressure equipment. The Directive foresees an arrangement for the exchange of experience between member states. In order to ensure a level playing field, cooperation of notified bodies within the Directive 2010/35/EU is a key element in the correct application of the legal instrument across the EU and in the associated member states. This is the objective of this action, noting also that all similar directives benefit from such technical secretariat support services. Since 1999 the EU industrial gas transport has been fully free, first under Directive 1999/36/EC and subsequently under 2010/35/EU on transportable pressure equipment (TPED). The Directive allows full mutual recognition of these equipments and their compulsory in-use inspections. Thus the gas market has benefited from a full free circulation, where cylinders, pressure tanks and other equipment do not need to be regularly returned to their country of origin for inspections. The wasteful transport of empty equipment purely for administrative reasons has been abolished. Notified bodies are called upon to issue the certificates of conformity assessment, certificates of reassessment of conformity and reports of periodic inspections, intermediate inspections and exceptional checks of transportable pressure equipment, according to Art. 12 of the Directive. According to its Art. 29, the Commission shall ensure that appropriate coordination and cooperation between bodies notified under the Directive are put in place and properly operated in the form of a sectorial group of notified bodies. However the experience in implementing the TPED has shown the need to assist the chairman of the group of conformity assessment bodies by a stable technical secretariat, as currently the effectiveness and efficiency of this group has been limited by the fact that this function has been up to now only assured on a rotational and voluntary basis. For this reason the identification and appointment of a permanent technical secretariat would be instrumental to improve the application of the provisions of the Directive 2010/35/EU and of the Directive 2008/68/EC, including by providing support to the establishment of TPED guidelines and in making them available to the relevant public. The technical secretariat would need to cover at least 80 men days per year for a period of 3 years. The experts selected to perform technical secretariat functions should be experienced in following the evolution of Directive 2010/35/EU and Directive 2008/68/EC and of the relevant standardisation activities, as applicable for the purposes of the TPED.

The tenderer must prove experience of 5 years in the transportable pressure equipment framework — Directive2010/35/EU and Directive 2008/68/EC as well as in the related standardisation process. The tenderer must provide proofs of access to the applicable standards. The tenderer must prove experience of 2 years in the preparation and conducting of secretarial work for meetings, ability to draft meeting agendas, working documents and minutes as well as to provide overviews. The tenderer must prove capacity to draft reports on the subject of transportable pressure equipment in English.
