The contract involves joint procurement, carried out by Terna Rete Italia on its own behalf and in the name and on behalf of EDF, and the applicable national procurement law is the Italian Law.
Sezione II: Oggetto
Tender 0000029642 — CIG 7950486499 — CUP G35J10000070001 — HVDC 3 Terminal Bipolar Interconnection ‘SA.CO.I.3’ 2 x 200 MW and 2 x 75 MW for Intermediate Terminal ± 200 kVcc
SA.CO.I.3 is a project jointly developed by Terna S.p.A. and EDF SA.
The SA.CO.I.3 project includes new 3-terminal HVDC interconnection between Sardinia, Corsica and Italian peninsula that will be realised by means of Line Commutated Converter (LCC) technology in bipolar configuration with electrodes. The rated DC voltage of each converter terminal will be ±200 kV with a nominal active power of 400 MW (Italian side) and 150 MW (French side).

The procurement relates to all activities, services, works and supplies necessary for the design, development and turnkey delivery of the 3 Terminal Interconnection, complete and fully operational.

Sezione III: Informazioni di carattere giuridico, economico, finanziario e tecnico
Tenderers must prove their economic, financial, technical and professional capacity to carry out the works subject to this Contract Notice.
Suppliers must provide the documents required in Art. 1, letter A, points from 1) to 8) of the ‘Pre-qualification Rules’ available in the Procurement Portal.
Suppliers must provide the documents required in Art. 1, letter B, points from 1) to 3) of the ‘Pre-qualification Rules’ available in the Procurement Portal.
Suppliers must provide the documents required in Art. 1, letter C of the ‘Pre-qualification Rules’ available in the Procurement Portal.
Guarantees and deposits will be required, the types, amounts and conditions will be defined/prescribed in the call for tender, according to the applicable law.
Payment will be at milestones achievement according to the tender procurement documents.
In case the candidates apply on a joint venture, temporary grouping or consortium basis, such aggregations have to ensure the joint and several liability of all their members to the extent required by Italian procurement law. The contracting entities may require groups of economic operators to assume a specific legal form and their members to bear joint and several liability once they have been awarded the contract to satisfy the client’s requirement for the project to be built on a single engineering, procurement and installation basis.
The procurement involves the establishment of 2 separate EPC contracts (bi-partite contracts) and 1 common agreement (tri-partite contract).
Each EPC contract will be a bi-partite contract, one between Terna Rete Italia and the supplier for N.2 LCC converter stations 400 MW located in Codrongianos (Sardinia, Italy) and in Suvereto (Tuscany, Italy), the other one between EDF and the Supplier for N.1 LCC converter station 150 MW located in Lucciana (Corsica, France).
Each EPC contract shall include specific technical specifications, specific terms and conditions for Terna Rete Italia or for EDF and the Common Agreement (including common technical specifications) as an annex to each EPC contract. The Common Agreement shall be signed by Terna Rete Italia, EDF and the supplier.
Total maximum estimated value TERNA's EPC contract: 220 000 000,00 EUR (two hundred twenty millions).
Total maximum estimated value EDF's EPC contract: 130 000 000,00 EUR (one hundred thirty millions).

Judicial claims against the contract notice, the exclusion or admission of tenderers and the final award decision are regulated by Art. 120 of legislative Decree 2.7.2010 No 104.
Any claim must be lodged within thirty calendar days from the publication of the contract notice, the serving and/or publication of the admission/exclusion decision or the final award notice. Absent a publication of the award notice or of notification of the contract signature, an application to the competent court may be made until the expiry of a six (6) months period starting at the day after the date of conclusion of the contract.
