Section II: Object
Consultancy Services Framework
ng homes are looking to appoint suitably qualified suppliers to their consultants Framework Agreement covering 4 lots for provision of the following services — quantity surveyors, structural and civil engineers, architects, and mechanical and electrical engineers.
It is intended that the Framework Agreement shall be for a period of 4 years, during which ng homes shall be entitled to call-off services from the Framework Agreement. It is estimated that the value of the services to be called-off over the 4 year period will be circa 880 000 GBP.
It is anticipated that 5 bidders will progress to ITT stage per lot and it is envisaged there will be 3 Framework Agreements awarded per lot — 3 successful suppliers per lot.
Quantity Surveying Consultancy Services
Lot 1 — Quantity Surveying:
The provision of quantity surveying consultancy services including, but not limited to, the following areas:
— tender preparation,
— tender analysis and evaluation
— contracts negotiation,
— drafting contract conditions,
— contract administration,
— commercial management,
— cost estimating and cost planning.
The consultant will also be capable of carrying out the following roles:
— employer's agent,
— principal designer, which includes managing and mitigating any potential health and safety risks throughout the process,
— contract administrator,
— procurement consultant.
Further services as mutually agreed between the Contracting Authority and Consultant will be required.
It is intended that a total number of 5 candidates be invited to tender stage for this Framework Agreement. The selection criteria is set out below.
These candidates shall be those who have:
— submitted a compliant submission, comprising the completed ESPD,
— satisfied the relevant selection criteria under the exclusion grounds,
— gained PASSES in respect of the economic and financial criteria in ESPD Part IV Section 4B,
— gained PASSES in respect of the suitability and technical and professional ability and management systems criteria in ESPD Part IV Sections 4A, 4C and 4D,
— scored at least 2 in respect of the examples provided for ESPD Part IV Section 4C1.1/4C1.2,
— achieved the first, second, third, fourth or fifth highest ranked Total Score for ESPD, Part IV, Section 4C1.1/4C1.2.
Any submission which fails to comply with the first 5 conditions shall be excluded from the ranking of scores for the final condition.
Structural and Civil Engineers Consultancy Services
Lot 2 — Structural and Civil Engineers:
The provision of engineering consultancy services specifically in the following disciplines:
— structural engineers,
— civil engineers.
The consultant will also have the capability and capacity to fulfil the roles of contract administrator and principal designer in order to plan, manage, monitor and coordinate the pre-construction phase. This includes managing and mitigating any potential health and safety risks throughout the design process.
Further services as mutually agreed between the Contracting Authority and consultant will be required.
Architectural Consultancy Services
Lot 3: Architects.
The provision of Architectural consultancy services including, but not limited to, the following areas:
— design and documentation services compatible with the RIBA plan of work 2013 — production of architectural drawings, engineering drawings, design drawings,
— construction administration services.
Mechanical and Electrical Engineering Consultancy Services
Lot 4: Mechanical and Electrical Engineers.
The provision of mechanical and electrical consultancy services including, but not limited to, the following areas:
— provision of engineering design and guidance regarding materials selection and installation options,
— upgrades to housing including rewiring, heating, lighting, fire and smoke detection, water pumps, door entry systems,
— replacement systems must comply with current building standards.
Section III: Legal, economic, financial and technical information
The relevant requirement is set out in the ESPD, Part IV Selection Criteria [4A1a] Enrolment in a relevant professional register. The following statement clarifies the requirement:
If required by the member state, bidders are required to be enrolled in the relevant professional or trade registers within the country in which they are established.
The relevant trade register in the UK is the Companies House register: //www.gov.uk/government/organisations/companies-house or equivalent in other countries.
The relevant requirements are set out in the ESPD, Part IV Selection Criteria, Section 4B.
Bidders shall provide:
— ESPD [4B1a] — a copy of their audited accounts or equivalent for the most recent 2 years, along with details of any significant changes since the last year end,
— confirmation that they currently hold, or can commit to obtain prior to the commencement of the framework agreement, the required levels of insurances.
Bidders are required to satisfy minimum standards of economic and financial standing as described in the ESPD, Part 4B6.
The following evaluation criteria are scored:
— operating profit ratio,
— gearing ratio.
The scoring mechanism can be downloaded from the additional documents, located within the additional notice options of the Public Contracts Scotland portal.
The 2 evaluation criteria will be individually scored and given a total aggregated score out of a possible 30 marks, for each year of trading. Each year's score will be weighted with the most recent (Year 1) weighted at 50 % and the previous year (Year 2) weighted at 50 %, and then aggregated to form an overall score for the for the 2 years out of 30 marks.
If the bidder is trading for less than 2 years, their financial ratios for the most recent full year of trading will be weighted at 2/3rds scored out of the total 30 marks.
The Contracting Authority reserves the right to fail any submission that scores less than 15 marks out of the potential aggregated score of 30 marks.
Required levels of insurances:
— employer's (compulsory) liability: 10 000 000 GBP,
— professional indemnity insurance: 5 000 000 GBP,
— public liability insurance: 5 000 000 GBP.
ESPD: Question 4C1.1/4C1.2 — bidders are required to provide 3 relevant examples addressing the areas covered in the ESPD. Such examples will be scored based on the following scoring mechanism:
0 — Unacceptable, nil or inadequate response. Fails to demonstrate previous experience/capacity/capability relevant to the scope.
1 — Poor. response is partially relevant but generally poor. The response shows some elements or relevance to the criterion but contains insufficient/limited detail or explanation to demonstrate previous relevant experience/capacity/capability.
2 — Acceptable response. Answer is relevant and acceptable. The response demonstrates broad previous experience, knowledge and skills/capacity/capability but may lack in some aspects e.g. previous experience, knowledge or skills may not be of a similar nature.
3 — Good response. Answer is relevant and good, sufficiently detailed and demonstrates a good amount of experience, knowledge or skills/capacity/capability.
4 — Excellent response. Answer is completely relevant and excellent overall. The response is comprehensive, unambiguous and demonstrated thorough experience, knowledge or skills/capacity/capability.
Submissions will be marked as a fail and will not be considered if the score for this section is less than 2 — Acceptable.
After the bidder's response has been scored it will receive a score out of 100 marks based on the evaluators' scores.
Words in excess of 800 words per example will not be considered or scored.
ESPD: Question 4C6 — bidders will have to confirm their managerial staff and staff generally hold the required professional qualifications for each lot. Full details found in the ESPD Question 4C6.
Evidence will be requested on award of the Framework Agreement. If bidders cannot confirm that they meet the requirement their submission will be marked as a fail.
The Contracting Authority will measure the performance of each consultant on a regular basis.
In the event that the consultant's performance falls below a satisfactory level, the consultant will be invited to determine a means of rectifying the situation. Repeated or continual services failures shall result in suspension or termination of the consultant's participation in the Framework Agreement.
