In the case of joint offers, the grouping will appoint, and will be represented by 1 legal entity that will act as its sole spokesperson and will be fully liable and responsible for performance of the framework agreement. The Bank will treat all contractual matters (e.g. payment) with this legal entity.
All members of the grouping assume joint and several liability towards the Bank for the performance of the framework agreement as a whole. Statements saying, for instance:
— that one of the tenderers in the joint offer will be responsible for part of the framework agreement and another one for the rest, or
— that more than 1 contract should be signed if the joint offer is successful,
are thus incompatible with the principle of joint and several liability. The Bank will disregard any such statement contained in a joint offer, and reserves the right to reject such offers without further evaluation on the grounds that they do not comply with the tendering specifications.

Information and formalities necessary for evaluating if the requirements are met: Exclusion criteria documentation: declaration in Annex 1 to the ‘General administrative and submission clauses’ (form regarding the exclusion criteria: declaration regarding the exclusion criteria and the absence of conflict of interest) duly signed and dated by an authorised representative (sole tenderer or lead contractor) stating that they are not in one of the situations listed in Annex 1 to the ‘General administrative and submission clauses’. The successful tenderer shall provide the documents mentioned as support evidence in this Annex before signature of the contract and within the deadline specified by the Bank.
To be eligible, all tenders must cover all the requirements of the tender and include all the documentation (Annexes 2–7 of the ‘General administrative and submission clauses’). Failure to cover all requirements of the tender and include all documentation will result in elimination.
