A. The tenderer must observe the mandatory grounds for exclusion as stated in Sections 134a, 135 and 136 of the Public Procurement Act. The tenderer must state in part III.A-D of the ESPD whether the tenderer observes each of the mandatory grounds for exclusion. Reference is made to the tender conditions.
B. The tenderer to whom the contracting authority intends to award the contract must provide documentation of the information provided in the ESPD. As documentation that neither the tenderer’s company nor any member of the management has been caught by the exclusion grounds in section 135 of the Public Procurement Act the following must be provided:
— Danish tenderers: a ‘serviceattest’ issued by the Danish Business Authority,
— Tenderers established in EU or EEA: relevant documentation as listed in e-Certis,
— Tenderers from other countries: relevant certificates or documents issued by public authorities in the country in questions. Where the country does not issue such certificate or documents, they may be replaced by a declaration under oath or if a declaration under oath is not a possibility in the country in question, a solemn declaration.
As documentation the tenderer had an annual turnover of at least one million EUR in the last financial year and positive equity in total over the last three financial years,
the tenderer shall provide an extract from the relevant financial reports and a link to the website where this information is published.
