II.2.4)Description of the procurement:

Postopek bo potekal v treh fazah. Naročnik bo v prvi fazi po prejemu ponudb (prijav) izvedel javno odpiranje. Po prejemu in pregledu prijav bo kandidate, ki bodo imeli dopustne prijave, pozval k enemu ali več ločenih krogov ustnih pogajanj. V primeru, če bodo kandidati z dopustnimi prijavami več kot trije, bo naročnik v naslednji krog konkurenčnega dialoga povabil le prve tri kandidate, ki jih bo izbral na podlagi meril, ki so navedena v teh navodilih. Vse kandidate bo obvestil o njihovem uspehu preko portala javnih naročil.

Način in vsebino pogajanj v drugem krogu fazi dialoga - bo opredelil s povabilom kandidatom. Naročnik si pridržuje pravico, da bo izvedel več kot en krog ločenih pogajanj. Naročnik se bo v tej fazi pogajal o vseh elementih pogodbenih določil ter predmetu pogodbe.

Po zadnjem krogu pogajanj bo naročnik pripravil končno tehnično dokumentacijo v postopku in končni vzorec pogodbe ter kandidate pozval k oddaji ponudb v zadnji (tretji) fazi konkurenčnega dialoga.

Način in vsebino postopka v zadnji fazi konkurenčnega dialoga bo naročnik opredelil v končni razpisni dokumentaciji, ter navedel, da gre za končno oddajo ponudb, oziroma bo vnaprej opredelil potek zadnje faze. Odpiranje končnih ponudb bo javno. V primeru, če bodo vse končne ponudbe nedopustne si naročnik pridržuje pravico postopek vrniti v drugo ali tretjo fazo konkurenčnega dialoga.

Ponudniki, ki se v posamezni fazi dialoga kljub povabilu ne bodo udeležili bodo izločeni iz nadaljnjega postopka in oddaje končne ponudbe naročnik bo štel, da so odstopili od postopka, ne bo pa jim uveljavil morebitnih finančnih zavarovanj, ki bi bila dana v postopku razen v primeru, če bi odstopil od končne ponudbe v tretji fazi postopka, za katero bi bilo dano zavarovanje.
