1. Economic operators may apply for a contract if they: shall not be excluded from the procedure pursuant to Article 108. 1 of the PPL, they are not excluded from the procedure under Article 109. 1(4) of the Public Procurement Act

2. The contractor must attach to the tender the current one on the date of submission of the tenders (in accordance with Article 125. 1 PPL) declaration of non-exclusion and compliance with the conditions for participation in proceedings (ESPD); this declaration shall be submitted by the economic operator in the form of the European Single Procurement Document (ESPD) annexed to Commission Implementing Regulation (EU) 2016/7 of 5 January 2016 establishing the standard form for the European Single Procurement Document (OJ EU L 3, 6.1.2016, p. 16).

7.2. In the case of joint procurement by economic operators, the declaration shall be submitted by each economic operator.

3. Before selecting the most advantageous tender, the contracting authority shall request the most successful tenderer to submit, within a specified time limit of not less than 10 days as at the date on which the evidence is submitted, unless the contracting authority has or has access to such means of proof (and the economic operator indicates those means and confirms their accuracy and timeliness):

(1) information from the National Criminal Register in respect of Article 108. 1(1) and (2) of the Public Procurement Act and Article 108. Article 1(4) of the Public Procurement Act, concerning a decision prohibiting the award of a public contract by way of a criminal measure – made no earlier than 6 months before its submission;

(2) a statement, within the scope of Article 108. Article 1(5) of the Act, which does not belong to the same group within the meaning of the Competition and Consumer Protection Act of 16 February 2007, with another economic operator who has submitted a separate tender, a partial offer or an application to participate in the procedure, or a declaration of membership of the same group, together with documents or information confirming the preparation of the tender, the partial tender or the request to participate, independently of another economic operator belonging to the same group;

(3) a declaration that the information contained in the declaration referred to in point 7.1 of the VCS is up-to-date in so far as it relates to the grounds for exclusion set out in Article 108. Article 1(3) to (6) of the Public Procurement Act;

(4) a copy or information from the National Court Register or from the Central Register and Information on Business, within the scope of Article 109. 1(4) of the Act, drawn up not more than 3 months before its submission, if separate provisions require entry in a register or register.

4. The provisions relating to the economic operator shall apply mutatis mutandis to joint tenderers.

5. The provisions of the Regulation of the Minister for Labour and Technology of 23 December 2020 on the subjective means of proof and other documents or declarations which the contracting authority may require from the contractor and the Regulation of the President of the Council of Ministers of 31 December 2020 on the method of drawing up and transmitting information and technical requirements for electronic documents and means of electronic communication in public procurement or competition procedures apply to the procedure.

VI.4.3)Review procedure
Precise information on deadline(s) for review procedures:

1. The legal remedies are set out in Section IX of the Public Procurement Act.

2. The appeal shall be lodged within the following periods:

1) 10 days from the date of communication of the contracting authority’s acts giving rise to its submission, where the information has been transmitted by electronic means; 15 days if the information was transmitted by means other than those referred to in the previous sentence;

(2) in respect of the content of the notice instituting the procedure or of the procurement documents, within 10 days of the date of publication of the notice in the Official Journal of the European Union or of the procurement documents on the internet;

(3) in cases other than those referred to above, 10 days from the date on which the circumstances giving rise to it were taken or diligently become known;

(4) where, despite such an obligation, the contracting authority has not notified the economic operator of the selection of the most advantageous tender, the review shall be lodged no later than:

30 days from the date of publication of the contract award notice in the Official Journal of the European Union,

(b) 6 months from the date of conclusion of the contract if the contracting authority has not published a contract award notice in the Official Journal of the European Union.
