Bosnia and Herzegovina-Teslić: EIB - Rehabilitation, upgrading and construction of wastewater treatment plants

International Invitation for Tenders
The Municipality of Teslic, Bosnia and Herzegovina (hereinafter referred to as “the Promoter”) has received a loan from the European Investment Bank – EIB (hereinafter referred to as “the Bank”) – towards the cost of the Expansion of water supply network, water supply improvements, and sewerage wastewater treatment in the Teslic Municipality project for the Municipality of Teslic. This International invitation for tenders relates to the contract for Construction of WWTP Teslic.
This contract will be based on FIDIC Yellow Book conditions of contract and include:
Design, construction, testing and commissioning of a complete and fully functional Wastewater Treatment Plant in Teslić, and associated sewerage connection. The main objective of the Works is the environmentally sound treatment and disposal of wastewater. The works shall be executed on the basis of a Design – Build Contract (FIDIC Yellow Book) and shall provide a WWTP capacity of 20 800 PE in the design year 2030 (Stage 1) and shall include:
— All WWTP buildings (administration, preliminary treatment, dewatering, substation, blower house – if required), pumping stations, roads, landscaping, security, SCADA, auxiliary networks, etc.
— All inlet works and preliminary treatment, storm water tank and flow measurement channel.
— Biological reactor (extended aeration activated sludge), consisting of 2 oxidation ditches and 2 circular sedimentation tanks).
— Recirculation and surplus sludge pumping station.
— Outlet works.
— Sludge thickening and dewatering by 2 belt thickeners and belt filter units, as well as feed pumps, polyelectrolyte preparation and dosing plant, system of sludge conveyors and cake containers.
— Flood protection backfill and slope revetment.
— All site pipe work (including for future extensions and provisions).
The civil works of the inlet pumping station, preliminary treatment, storm water tank, flow measurement channel, distribution chambers, sludge pumping station, service water tank, as well as the administration and service buildings shall be constructed for Phase 2.
The services, works and supplies to be provided by the contractor include indicatively, but are not limited to the following:
(1) Design and additional studies:
— Execution of topographical survey and geotechnical investigations. The scope of geotechnical investigations shall be determined by the Contractor taking into consideration design requirements as well as applicable laws and regulations of
— The contractor shall be responsible for obtaining the site permissions and all relevant permits for the construction period (e.g. permits for excavations, permits from traffic authorities, temporary connections for electricity, telephones and water etc.) as required by the local authorities. All expenses for site permissions and all relevant permits for the construction period shall be deemed to be included in the Accepted contract amount.
— The contractor shall be responsible for provision of all necessary designs, studies, technical and other support documentation requested by the Contracting Authority or engineer, which is necessary according to the local regulations for application for construction, environmental, water, use and other permits or permanent connections for electricity, telephones and water etc.. It is the Contracting Authority’s responsibility to pursue these permits and to provide them to the Contractor in order to proceed with the construction. All fees and costs for these permits and permanent connections to utility services shall be paid by the Contracting Authority.
— Preparation of the Design report (conceptual design for the wastewater treatment plant with the capacity of 28 800 p.e. (Design Phase 2)). Detailed design for the wastewater treatment plant to be constructed in Phase 1, and construction drawings for civil engineering structures, reinforced concrete drawings and calculation notes, drawings and calculation notes for the roads and utilities networks, drawings and diagrams of equipment, erection and dismantling drawings, in compliance with the detailed design accepted by the Contracting Authority.
— The project and other documentation produced by the Contractor shall be completed in accordance with the legal regulations of Republika Srpska and shall be written in both English and local language. Specifically, the documentation shall be produced by licensed and authorized companies and engineers, whereas the detailed designs shall be reviewed by an authorized and licensed company.
— Installation of the site and preparatory works, connection to power, telecoms, water and other networks.
— Construction of civil works in accordance with the approved detailed design.
— Supply, transportation on site, installation and adjustment of all mechanical and electrical equipment in accordance with the approved detailed design.
— The commissioning of the installation and performance of all the tests defined in the Contracting Authority’s requirements;
— Provision of maintenance and operating manuals, as-built drawings of all the individual structures and networks.
— Spare parts for fixed and mobile MEICA equipment, including instrumentation and control required for 2 years operation after issue of the Taking Over Certificate;
— Testing, commissioning and handover documentation;
— Training of the Contracting Authority’s operation and maintenance personnel (Training shall take place during the Defects Notification Period at a 3 months period).
The period of execution of the works Contract will be 34 months including a Design and Construction period of 22 months and a Defect Notification Period of 12 months.
Selection and award criteria:
The selection criteria for each tenderer are as follows:
— the tenderer must be a registered firm or natural person legally capable of carrying out the specified works;
— the tenderer shall provide accurate information on any current or past litigation or arbitration resulting from contracts completed or under execution by him over the last 5 years. A consistent history of awards against the tenderer or any partner of a joint venture may result in failure of the application.
Technical and professional capacity
a) Successful experience as prime contractor in the execution of at least 2 projects each with a minimum value of works 3 000 000 EUR and of a nature and complexity comparable to the proposed contract within the last 10 years.
b) Successful experience as main designer (himself or a nominated design consultant) of at least 3 projects including:
— 1 project of similar nature and complexity with the value of designed works of minimum 3 000 000 EUR;
— 2 projects of similar nature and complexity each with the value of designed works of 2 000 000 EUR In the case of Design-Build executed projects that fulfil cumulatively the amounts in criteria (a) and (b), proof of separate design experience is not required.
c) Proposed staff fulfil the Personnel Capabilities requirements
Economic and financial capacity
The average annual turnover of the tenderer in the last 3 years must be at least 6 000 000 EUR equivalent.
The Tenderer shall demonstrate, by a bank statement from its bank, that it has available or it has access to liquid assets, lines of credit, or other financial means sufficient to meet the construction cash flow for the contract, not less than 1 500 000 EUR equivalent, for a period of 6 months, in addition to the Tenderer’s commitments for other contracts.
The audited financial statements for the last 3 years as well as documented cash flow projections for the next 2 years shall be submitted and must demonstrate the soundness of the Tenderers financial position, showing long-term profitability.
Tenders submitted by companies in partnerships forming a joint venture/consortium must also fulfil the following requirements:
— the Joint venture/consortium must satisfy cumulatively all the specific criteria of Technical and Professional capacity and Economic and Financial capacity stated above.
— the lead partner shall meet individually the following particular criteria:
i) Average annual turnover over the last 3 years of 3 000 000 EUR equivalent;
ii) Successful experience as main contractor in the execution of at least one (1) project with the value of minimum 3 000 000 EUR. The project should be of nature and complexity comparable to the proposed contract and completed within the last 7 years;
iii) Shall demonstrate, by a bank statement from his bank that he has available or he has access to, liquid assets, lines of credit, or other financial means not less than 750 000 EUR equivalent, apart of the applicant’s commitments for other contracts;
iv) It shall also satisfy the litigation history
— All key personnel proposed for the execution of the Project shall have the minimum experience required below:
—— Key Positions: Project manager (Contractor’s representative)
Minimum years of experience in construction works of similar complexity: 15
Minimum years of experience in WWTP contracts: 5
Minimum years of experience in similar position in works of similar nature and complexity: 5
—— Key Positions: Assistant Project Manager
Minimum years of experience in construction works of similar complexity: 10
—— Key Positions: Mechanical Engineer
—— Key Positions: Electrical Engineer
—— Key Positions: Hydraulic&Process Engineer
Minimum years of experience in similar position in works of similar nature and complexity: 3
—— Key Positions: Surveyor
—— Key Positions: Civil Engineer
—— Key Positions: SCADA Engineer
—— Award Criteria
The Evaluation Committee will select the Tenderer who has submitted the most economically advantageous bid satisfying the administrative and technical criteria.

All firms are invited to participate in the tender. The EIB shall not provide finance, directly or indirectly, to or for the benefit of, award a contract under any EIB Project to, or enter into any relationship with, an individual or entity who is subject to financial sanctions imposed by the European Union pursuant to Chapter 2 of Title V of the Treaty on European Union or article 215 of the Treaty on the Functioning of the European Union, either autonomously or pursuant to the financial sanctions decided by the United Nations Security Council on the basis of article 41 of the UN Charter. This applies without the need for the Exclusion proceedings.

The payment shall bear the name of the project. On request, against a faxed or e-mailed copy of the evidence of the remittance, the Bidding documents may be sent by courier service if the transport is previously ordered by the Bidder in his country. The borrower bears no responsibility for the delivery in such a case.
A Bid Security of 45 000 EUR fulfilling the conditions indicated in the Bidding documents must accompany all bids.
All bids must be delivered in closed envelopes, including 2 separate envelopes for Technical and financial offers, bearing the mention “Bid for Construction of WWTP Teslic” not later than 26 – September 2018 at 11:00 am Central European Time at the following address:
