Furnizarea de obiecte de inventar de resort medical, conform caietului de sarcini, prin incheierea unui acord-cadru cu operatorii economici ale caror oferte admisibile se vor pozitiona pe primele trei locuri in clasamentul intocmit in baza criteriului de atribuire mentionat la punctul II.2.5.din fisa de date a achizitiei. Contractele subsecvente se vor încheia cu operatorul economic declarat câștigător pentru cantitățile solicitate de către utilizatorul respectiv.

Numar de zile pana la care se pot solicita clarificari inainte de data-limita de depunere a ofertelor/candidaturilor: 20 de zile.

Autoritatea contractanta va raspunde in mod clar tuturor solicitarilor de clarificari/informatii suplimentare in a 11-a zi inainte de data-limita de depunere a ofertelor, conform termenului fix stabilit in OUG 107/2017.

Cerința nr.1.

Ofertanții, asociatii, terții susținători și subcontractanții nu trebuie să se regăsească în situațiile prevăzute la art.164, 165, 167 din Legea nr. 98/2016

Modalitatea de îndeplinire:

Se va completa DUAE în conformitate cu art. 193 alin. (1) din Legea nr. 98/2016

Pentru fiecare lot la care participă, ofertantul după înscrierea în SEAP în procedură completează Răspuns DUAE” (inclusiv pentru asociaţi/ subcontractanți/ terţi susţinători) ca primă dovadă a neîncadrării în situaţiile de excludere, cu informațiile aferente situației lor. Daca informatiile din DUAE sunt identice, se pot cumula loturile respective si se poate depune un DUAE comun in care se specifica pentru ce loturi este depus. Se completeaza cate un DUAE distinct pentru fiecare ofertant. Nedepunerea „Răspuns DUAE” cu oferta (inclusiv pentru asociat/ subcontractant/ terţ susţinător) atrage respingerea acesteia ca inacceptabilă. Se recomanda consultarea Ghidului de utilizare DUAE elaborat de ANAP disponibil la adresa www.anap.gov.ro. Instructiuni privind completarea DUAE sunt disponibile la adresa www.e-licitatie.ro.

Documentele justificative care probează îndeplinirea celor asumate prin completarea DUAE urmează a fi prezentate, la solicitarea autorității contractante doar ofertantilor clasati pe primele 3 locuri în clasamentul intermediar întocmit la finalizarea evaluării ofertelor sunt:

— certificate constatatoare (certificate de atestare fiscală emise de autoritățile locale și de ANAF) privind lipsa datoriilor scadente, cu privire la plata impozitelor, taxelor sau a contribuțiilor la bugetul general consolidat (buget local, buget de stat etc.). Acestea trebuie să fie valabile la momentul prezentării,

— cazierul judiciar al operatorului economic și al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control în cadrul acestuia, așa cum rezultă din certificatul constatator emis de ONRC / actul constitutiv,

— după caz, documente prin care se demonstrează faptul că operatorul economic poate beneficia de derogările prevăzute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizițiile publice,

— alte documente edificatoare, după caz.

În cazul în care în țara de origine sau țara în care este stabilit ofertantul/terțul susținător/subcontractantul nu se emit documente de natura celor prevăzute mai sus sau respectivele documente nu vizează toate situațiile prevăzute la art.164, 165 și 167, autoritatea/entitatea contractantă are obligația de a accepta o declarație pe proprie răspundere sau, dacă în țara respectivă nu există prevederi legale referitoare la declarația pe propria răspundere, o declarație autentică dată în fața unui notar, a unei autorități administrative sau judiciare sau a unei asociații profesionale care are competențe în acest sens.

Daca ofertantul a fost în relatie contractuala cu autoritatea contractanta, iar operatorul economic si-a încalcat în mod grav sau repetat obligatiile principale ce-i reveneau în cadrul contractului de achizitii publice si autoritatea contractanta a fost pusa în situatia de a rezilia contractul sau acordul-cadru, emitand in acest sens un document constatator ramas definitiv, acest lucru atrage excluderea din procedura de atribuire a acestui operator economic dupa analiza comisiei de evaluare daca acest document constatator reflecta îndeplinirea conditiilor cumulative prevazute la art. 167 alin. (1) lit. g) din Legea 98/ 2016.

Note: Fiecare document va fi semnat de reprezentantul legal al ofertantului. În cazul în care acestea sunt semnate de o alta persoana, se va prezenta o Împuternicire din partea reprezentantului legal care sa ateste delegarea atributiunii in relatia cu autoritatea contractanta. Toate documentele vor avea, pe lânga semnatura, mentionat în clar numele, prenumele si functia semnatarului.

Cerinta nr. 2

Evitarea conflictului de interese

Operatorul economic (ofertant individual/ofertant asociat/subcontractant/tert sustinator) nu trebuie sa se încadreze în situatiile prevazute la art. 59 si art. 60 din Legea nr. 98/2016.

Modalitatea de îndeplinire:

Operatorii economici participanti la procedura de atribuire vor completa si depune Declaratia cu privire la conflictul de interese (declarația privind neîncadrarea în situațiile potențial generatoare de conflict de interese, cu menționarea persoanelor care dețin funcții de decizie în cadrul autorității contractante) în conformitate cu prevederile art. 59 si art. 60 alin. (1) lit. a), lit. d) si lit. e) din Legea 98 (Formularul este pus in sectiunea formulare).

Persoanele ce detin functii de decizie în autoritatea contractanta cu privire la organizarea, derularea si finalizarea procedurii de achizitie publica sunt: Popescu Constantin Cristian; Giuroiu Catalin Valeriu; Constantin Cristian; Ranete Ionut; Ivan Ionut Madalin; Tudorache Adriana Cristina.

Declarația va fi prezentată odată cu „Răspuns DUAE”, semnată cu semnătură electronică extinsă.

A. Inscrierea în Registrul Comertului - Certificat constatator

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de înregistrare în conditiile legii din tara de rezidenta, sa reiasa ca operatorul economic este legal constituit, ca nu se afla în niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.

Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, sunt obligatorii sa fie prezentate, la solicitarea autoritatii contractante, de catre ofertantii clasati pe primele 3 locuri în clasamentul intermediar întocmit dupa finalizarea etapei de evaluare a ofertei. Datele cuprinse in Certificatul Constatator vor fi reale/ actuale la data prezentarii. Documentele constatatoare trebuie sa ateste ca obiectul contractului are corespondent în activitatea operatorului economic pentru partea din contract pe care o realizeza (codul CAEN trebuie sa fie in concordanta cu tipul de produse livrate si servicii prestate). Alte informatii minimale ce trebuie sa se regaseasca în documentul constatator sunt: date de identificare legale (denumire, sediu, cod unic de înregistrare); activitatile principale si secundare; reprezentantii legali; situatia juridica a operatorului economic.

Operatorii straini vor demonstra indeplinirea cerintelor completand DUAE. Documentele justificative ce probeaza indeplinirea celor asumate prin completarea DUAE, respectiv documentele echivalente, emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, de catre ofertantii clasati pe primele 3 locuri în clasamentul intermediar întocmit dupa finalizarea etapei de evaluare a ofertei.

In situația în care vor fi executate părți din contract de către subcontractanți, dovada înregistrării și corespondența activităților principale/secundare din cadrul acestuia cu obiectul achiziției se va prezenta obligatoriu și de către subcontractanți, pentru partea din contract pe care o vor realiza.

În procedurile de atribuire a contractelor de achiziție publică/sectorială de produse care cuprind și prestarea de servicii conexe, în cazul în care este necesar ca operatorii economici să dețină o autorizație specială, sau să fie membri ai unei anumite organizații pentru a putea presta serviciile în cauză în statul de origine, sau să fie înscriși în registre profesionale, autoritatea/entitatea contractantă are dreptul de a solicita acestora să demonstreze că dețin o astfel de autorizație/că sunt membri ai unei astfel de organizații/sunt înscriși în registre profesionale. Dacă se impune avizarea/atestarea/autorizarea operatorului economic, aceasta trebuie să fie în relație directă cu obiectul principal al contractului/relevantă scopului urmărit prin încheierea contractului de achiziție publică/sectorială.

B. Avizul de functionare emis de ANMDM

Detinerea Avizul de functionare pentru comercializarea dispozitivelor medicale si, daca este cazul, pentru punerea în functiune în domeniul dispozitivelor medicale, aflat în termen de valabilitate la data prezentarii, emis de catre ANMDM, conform art. 926 din Legea 95/ 2006, privind reforma în domeniul sanatatii, republicata, si in conf. cu art. 3 din Ordinul nr. 1008/2016 pentru aprobarea Normelor metodologice de aplicare a titlului XX din Legea nr. 95/2006 privind reforma în domeniul sanatatii, referitoare la avizarea activitatilor în domeniul dispozitivelor medicale.

Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE, sunt obligatorii sa fie prezentate, la solicitarea autoritatii contractante, de catre ofertantii pentru loturile 1, 2 și 8 care sunt clasati pe primele 3 locuri în clasamentul intermediar întocmit dupa finalizarea etapei de evaluare a ofertei. Pentru operatorii straini se vor prezenta documentele echivalente, emise in tara de rezidenta, care vor fi prezentate în limba în care a fost emis, însotit de traducerea autorizată în limba română efectuată.

C. Obtinerea codului NCAGE înainte de semnarea primului contract subsecvent sau Prezentarea certificatului de acordare a codului NCAGE

Detinerea Certificatului de acordare a codului de agent economic (NCAGE) sau a Declaratiei prin care se angajeaza ca va obtine codul NCAGE înainte de semnarea contractului(se pune la dispozitie model orientativ). Operatorii economici care intentioneaza sa depuna oferta, au obligatia de a urmari/accesa site-ul www.e-licitatie.ro, pe toata durata de desfasurare a prezentei proceduri. Departajarea ofertelor cu preturi egale:

In vederea departajarii, se vor solicita clarificari prin intermediul SEAP ofertantilor la care s-au constatat aceste preturi egale, pentru a introduce o noua propunere financiara imbunatatita al carui pret va fi format din 2 zecimale. Oferta va putea fi îmbunatatita pâna la nivelul ofertei superioare locului ce face obiectul reofertarii, fara ca aceasta sa afecteze pozitiile superioare în clasament ocupate de ceilalti ofertanti. Daca în urma acestei operatiuni nu se realizeaza departajarea primelor 3 locuri, se reia operatiunea doar inca o data. Daca dupa a doua reofertare nu se departajeaza locurile 1-3, autoritatea contractanta va anula procedura de atribuire, in baza art 212, alin.1, lit c din Legea 98/ 2016.

În cazul în care nu au fost primite cel puțin 3 oferte declarate admisibile, se va incheia acordul cadru cu toți operatorii economici ale căror oferte au fost declarate admisibile.

Prezenta fisa de date se completeaza cu “Informatiile pentru ofertanti” din cadrul documentatiei de atribuire (fisier atasat). Elementele/condiţiile care rămân neschimbate pe întreaga durată a acordului-cadru centralizat sunt: Obligaţiile pe care operatorul economic şi le-a asumat prin propunerea tehnică; Clauzele contractuale.
