Modalitatea prin care poate fi demonstrata indeplinirea cerintelor: se va completa DUAE de catre operatorii economici participanti la procedura de atribuire informatii aferente situatiei lor.

Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul 1 in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Acestea sunt:

1. Certificat constatator, eliberat de Oficiul Registrului Comertului (in original/ copie lizibila cu mentiunea conform cu originalul) din care sa reiasa ca ofertantul are ca obiect de activitate principal sau secundar comercializarea produselor solicitate prin prezenta documentatie de atribuire. Informatiile cuprinse in certificatul constatator trebuie sa fie reale/ actuale la data prezentarii acestuia. Operatorii economici straini vor prezenta documente echivalente emise in conformitate cu legislatia aplicata in tara de rezidenta. Documente justificative sau documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul 1 in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

2. Autorizatie de distributie angro a materialelor sanitare eliberata de Agentia Nationala a Medicamentului (ANM), in conformitate cu prevederile art. 788 alin. (1) din cap. VII al titluluiXVII din Legea nr. 95/2006, cu modificarile si completarile ulterioare, in copie lizibila cu mentiune“conform cu originalul”. Operatorii economici straini vor prezenta documente echivalente emise in conformitate cu legislatia aplicata in tara de rezidenta. Documente justificative sau documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul 1 in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

3. Declaratie pe proprie raspundere prin care se confirma ca produsele ofertate detin autorizatie de punere pe piata eliberata de catre Ministerul Sanatatii, in conformitate cu Legea 95/2006 privind reforma in sanatate. Operatorii economici straini vor prezenta documente echivalente emise in conformitate cu legislatia aplicata in tara de rezidenta.Documente justificative sau documente echivalente emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul 1 in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevezute de art 164, 165, 167 din Legea 98/2016.

Se va completa formularul DUAE de catre toti operatorii economici in conformitate cu ART. 193 si ART. 196 din Legea 98/2016

Operatorii economici nerezidenti pot prezenta autoritatii contractate certificate/autorizatii corespunzatoare emise in tara de rezidenta care confirma posibilitatea prestarii activitatii in cauza.

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta din care sa reiasa ca operatorul economic este legal constitutit, ca nu se afla in niciuna din situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului; se vor prezenta documente echivalente emise in tara de rezidenta.

Acest document se va prezenta in oricare din formele: copie legalizata sau copie lizibila cu mentiune “conform cu originalul”, urmeaza sa fie prezentate la solicitatea autoritatii contractante, doar de catre ofertantul clasat pe locul 1 in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
