    • absence of competition for technical reasons
Explanation:

Radian Group Limited (Radian) intends to award the Contract to Hampshire Homes Group Ltd (HH) pursuant to Regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015 (the Regulations). Radian is of the view that the Contract can only be awarded to HH because competition is absent for technical reasons.

Radian bought the Hanover Way site on the open market following a competitive bidding process. HH provided extensive assistance to Radian with its bid for the site, including development of the detailed design for the proposed scheme. HH therefore has extensive knowledge of the scheme, and has offered Radian an extremely competitive build price for the scheme together with commercially advantageous terms and conditions.

Radian is therefore of the view that if it were to seek to procure the Contract in accordance with the Regulations competition would be absent for technical reasons because no contractor in the market would realistically be able to compete with HH's offering for the Contract, due to the unparalleled understanding that HH has of the scheme and the build cost and terms and conditions it is prepared to offer Radian.

Any such proceedings must be brought within the limitation period specified by the Regulations according to the remedy sought.
