Es wird ergänzend der Hinweis gegeben, dass sich die Regierung von Oberbayern

in der Vergangenheit für Ausschreibungen der Vergabestelle sowohl im Unter- als auch im

Oberschwellenbereich als Nachprüfungsstelle für nicht zuständig erklärt hat. Dies wurde damit

begründet, dass das Berufsförderungswerk München gGmbH als gemeinnützige Gesellschaft

(gGmbH) keiner Rechts- und Fachaufsicht von staatlicher Seite unterliege.

Weiter wurde als Begründung der Nichtzuständigkeit in der Vergangenheit angeführt, dass es sich

nicht um eine geförderte Maßnahme gehandelt habe. Da das gegenständliche Bauvorhaben

ebenfalls ein nicht gefördertes Projekt darstellt, legt dies nahe, dass diese Beurteilung

der Unzuständigkeit durch die Nachprüfstellen auch in diesem Vergabeverfahren wieder

eingenommen werden könnte.
