To prove that they are not in any of the situations referred to in Articles 106 and 107 of the Financial Regulation applicable to the budget of the Union, candidates must provide a declaration on their honour, duly signed and dated by a legal representative of the company. Section III: Legal, economic, financial and technical information
III.1)Legal form to be taken by the grouping of suppliers, contractors or service providers to whom a contract might be awarded:
Participation is open to all legal entities participating individually or as part of a consortium of candidates or subcontractor. Any interested economic operator must fill in and sign the declaration on exclusion and selection criteria.
In case of a group of economic operators/consortium or subcontractor, each member of the group or each subcontractor must submit a declaration on exclusion and selection criteria duly signed and dated.
All members of the consortium, including subcontractors, must not be in any of the exclusion situations mentioned in Article 106 and 107 of the Financial Regulation (Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council of 25.10.2012, modified by Regulation (UE, Euratom) 2015/1929 of the European Parliament and the Council of 28.10.2015).
The signed declaration on honour stating that the candidate is not in any of the situations leading to exclusion from participation in procurement procedures will be verified by the contracting authority, as required.
The Secretariat reserves the right to request any subcontractors to submit the supporting documents listed in the declaration on honour — Section VII — Selection criteria.

IV.2)Grounds for exclusion:
Applicants shall be excluded from participating in a contract if:
(a) they are bankrupt, being wound up or have suspended business activities, their affairs are being administered by the court, they have entered into an arrangement with creditors or similar measures or are the subject of any proceedings of that nature, or are in any analogous situation arising from a similar procedure provided for in national legislation or regulations;
(b) they have been convicted of an offence concerning their professional conduct by a judgment which is not open to appeal;
(c) they have been guilty of grave professional misconduct;
(d) they have not fulfilled obligations relating to the payment of social security contributions or taxes;
(e) they are guilty of serious misrepresentation in supplying the information required by the authorising department;

The candidate must have the legal and regulatory capacity to pursue the professional activity needed for performing the contract, prove a minimum turnover of 65 000 EUR for each of the last 3 financial years, and present 3 references for contracts with a minimum value of 30 000 EUR each which are ongoing or have been completed within the last 3 years.

Applications to appear on this list may be submitted at any time during the period of validity of this list, with the exception of the last 3 months of that period.

Section VI: Complementary information
VI.1)Presentation and submission of applications:
Economic operators interested in the contracts, the object of which is described in point III.1 of this notice, are invited to submit a request to participate.
Steps to follow:
a. the form for the declaration on honour is accessible on: https://etendering.ted.europa.eu/cft/cft-display.html?cftId=2815
b. fill in the form giving details of the company you are representing. The form must be duly signed and dated by a legal representative of the company (proof of authorisation must be provided).
A copy of any official document must be attached (e.g. official gazette, register of companies, etc.) showing the company's name and address and the registration number allocated by the national authorities as well as a copy of the VAT registration document if applicable and if the VAT number does not appear on the aforementioned official document. Candidates registered as an individual must enclose a legible photocopy of their identity card or passport;
c. candidates may either send their request to participate by registered mail to the postal address mentioned in point I.1) above or have it delivered by hand or via a private courier service to the following address: chaussée d'Etterbeek 70 — unloading bay, 1040 Brussels, BELGIUM (the ‘quai de déchargement’ (unloading bay) is open from 8:30 until 16:30 on working days).
The envelope must bear the reference ‘AMI 028/17’.
Faxed or e-mailed requests to participate shall not be accepted.
All the supporting documents requested in ‘Section VII — Selection criteria’ of the declaration on honour must be attached to the application.
VI.2)Additional information:
The contracting authority will draw up a list of candidates who meet the selection criteria set out in the declaration on honour.
Each time a contract is to be concluded relating to the field described in point III.1, the contracting authority will invite all the candidates on the list to submit a tender.
The list resulting from this notice will be used solely for contracts which fall outside the scope of Directive 2004/18/EC of the European Parliament and of the Council.
The first call for tenders stemming from this call for expressions of interest is likely to be launched in September 2017. We recommend therefore that interested economic operators send their request to participate as soon as possible. Candidates will be informed of the outcome of their applications.
