Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165, 167 din Legea 98/2016. Ofertantii, tertii sustinatori si subcontractantii vor depune documentul DUAE, iar operatorilor economici clasati pe primele doua locuri li se vor solicita documentele justificative pentru declaratiile din acest document, in vederea probarii acestora.

Vor fi exclusi din procedura operatorii economici care se regasesc in una din situatiile prevazute la art. 164, 165 si 167 din L98/2016.

In sensul verificarii prevazute la art. 170 alin. (1) din Legea nr. 98/2016, subcontractantii completeaza declaratia pe propria raspundere in conformitate cu prevederile art. 193-195 din aceeasi lege, precizand ca nu se afla in niciuna din situatiile ce atrag excluderea din procedura de atribuire.

Ofertantilor clasati pe locul I si II (deoarece acordul-cadru se incheie cu doi operatori economici) in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor, li se vor solicita, in vederea probarii celor asumate in DUAE, urmatoarele:

— certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidate (bugetul local si de stat) la momentul prezentarii;

— cazierul judiciar al operatorului economic si al membrilor organizatiei de administrare, de conducere sau de supraveghere al respectivului operator economic sau al celor ce au putere de reprezentare, de decizie sau control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/act constitutiv;

— dupa caz, documente prin care se demonstraza faptul ca operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2) si art. 171 din Legea 98/2016;

— alte documente edificatoare, dupa caz.

Ofertantii straini vor prezenta orice documente edificatoare, eliberate de autoritati competente din tara in care acestia sunt rezidenti, prin care sa dovedeasca lipsa datoriilor restante catre bugetul de stat si bugetul local, in conformitate cu legislatia din tara de rezidenta. Documentele se vor prezenta insotite de traducera autorizata a acestora in limba romana.

Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, din care sa reiasa ca sunt legali constituiti, ca nu se afla in niciuna dintre situatiile de anulare a constituirii, precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului. Modalitate de indeplinire: completare DUAE, in conformitate cu notificarea nr. 237/2016.

Ofertantilor clasati pe locul I si II in clasamentul intermediar li se va solicita certificatul constatator emis de ONRC sau pentru ofertantii straini document echivalent emis in tara de rezidenta.

Informatiile cuprinse in certificatul constatator sa fie actualizate in momentul prezentarii acestuia.

— Autorizatie de functionare emisa de MS, in conformitate cu art. 1 si 3 din HG 573/2002, care se va solicita ofertantilor clasati pe primele doua locuri la finalizarea evaluarii ofertelor. Informatiile sa fie reale/actuale la data limita de depunere a ofertelor.

Persoanele juridice straine pot prezenta documente echivalente emise in conformitate cu legislatia aplicabila in tara de rezidenta. Modalitatea de indeplinire: initial completare DUAE ca apoi documentul se va solicita ofertantilor clasati pe primele doua locuri;

— Dovada că echipamentul respectă normele europene de siguranţă şi calitate şi/sau standardele/reglementările europene în domeniul medical. În acest sens va depune orice document relevant, de exemplu, declaraţie de conformitate CE emisă de producător, pentru dispozitive medicale fabricate sau certificate de conformitate CE valabile pentru dispozitive medicale fabricate, dupa caz, ce atesta conformitatea produsului cu cerintele din Directiva Europeana 93/42/EEC revizuita.
