Uchádzač musí spĺňať podmienky účasti týkajúce sa osobného postavenia podľa § 32 ods. 1 zákona č. 343/2015 Z. z. o verejnom obstarávaní a o zmene a doplnení niektorých zákonov (ďalej len zákon o verejnom obstarávaní) spôsobom podľa § 32 alebo § 152 zákona o verejnom obstarávaní. V prípade uchádzača, ktorého tvorí skupina dodávateľov zúčastnená vo verejnom obstarávaní sa požaduje preukázanie splnenia podmienok účasti týkajúcich sa osobného postavenia za každého člena skupiny osobitne.
