Explanation:

Der öffentliche Auftraggeber hat den Auftrag im Verhandlungsverfahren ohne Teilnahmewettbewerb vergeben, weil aus technischen Gründen kein Wettbewerb vorhanden ist für ein Upgrade an einem am MPI-CBG vorhandenen Mikroskop Light Sheet Z1. Für dieses Upgrade müssen ausschließlich zum Originalgerät kompatible Komponenten zum Einsatz kommen, welche lediglich durch den Hersteller des Originalmikroskops, der Fa. Carl Zeiss Microscopy Deutschland GmbH, am Markt zur Verfügung gestellt werden.

Ein Nachprüfungsantrag ist unzulässig, soweit mehr als 15 Kalendertage nach Eingang der Mitteilung des AG, einer Rüge nicht abhelfen zu wollen, vergangen sind (§ 160 (3) Nr. 4 GWB 2016). Ein Nachprüfungsantrag ist zudem unzulässig, soweit der Antrag erst nach Zuschlagserteilung zugestellt wird (§ 160 (3) Nr. 1 GWB 2016). Die Zuschlagserteilung ist möglich 10 Tage nach Absendung (per Fax oder auf elektronischem Weg) der Bekanntgabe der Vergabeentscheidung (§ 134 (2) GWB 2016). Die Zulässigkeit eines Nachprüfungsantrages setzt ferner voraus, dass die geltend gemachten Vergabeverstöße unverzüglich nach Kenntnis bzw. - soweit die Vergabeverstöße aus der Bekanntmachung oder den Vergabeunterlagen erkennbar sind - bis zum Ablauf der Bewerbungs- bzw. Angebotsfrist gerügt wurden (§ 160 (3) Nr. 2 und 3 GWB 2016).
