Agreement for Procurement of Visitor Counters
Metsähallitus is a part of the state-owned organisation Metsähallitus. Its unit Parks and Wildlife Finland is in charge of public administration tasks and is comprised of National Parks Finland and Wildlife Service Finland. National Parks Finland manages state-owned nature reserves and historic sites, provides free facilities for visitors to these areas, compiles GPS data on conservation issues in protected areas, participates in international collaboration on nature conservation and maintains snowmobile routes.
Metsähallitus continuously monitors visitor numbers to the key protected and recreational areas under its management.
During next 4 years, Metsähallitus will acquire approximately 120 new visitor counters as well as related supplies and maintenance services through a procurement contract to be entered into on the basis of this announcement. Metsähallitus will perform public tendering for a new contract for visitor counters and related accessories. The estimated value of the contract exceeds the EU procurement threshold for goods and services. The agreement also includes the necessary access rights to the online service, in which the collected data is stored, as well as the implementation of interfaces for transferring data to the customer's own information systems.
The counting devices to be purchased shall be placed on natural structures at the main entrances of the areas. Due to environmental conditions, the devices must operate on battery power i.e. operate entirely without mains current and allow remote reading of data. The visitor counting devices shall, for example:
— form a whole which includes a sensor and a data collection unit,
— operate reliably all year round,
— be weatherproof (waterproof, frost-resistant to at least -30 oC) and reliable,
— be as unobtrusive as possible when installed in the countryside.
The estimated value of the four-year framework contract is approximately EUR 450 000 and the contract period is four (4) years.
The procurement complies with the Finnish Public Procurement and Concession Contracts Act (1397/2016).
Abschnitt IV: Verfahren
Metsähallitus published a preliminary notice of the acquisition in the TED Supplement to the Official Journal of the European Union on 7 February 2020 (TED Notice No 2020/S 027-060861). With the help of prior notification, Metsähallitus intended to survey the market and search for information on possible alternative suppliers and their counting solutions that met Metsähallitus' requirements, in addition to what was known in advance. Metsähallitus did not receive any requests to participate in the market dialogue.
As other market research activities did not provide information on alternative counter solutions that meet the requirements, Metsähallitus started procurement negotiations with the French manufacturer of counter solutions Eco-Compteur.
Due to the above, Metsähallitus decides to carry out the procurement through a direct procurement procedure from Eco-Compteur In accordance Article 32 (3) (b) (ii) of the Public Procurement Directive 2014/24/ EU of the European Parliament and the Council: ‘for technical or exclusive protection reasons only a certain supplier may perform the procurement’.
The market investigation has shown that there are no sensible alternatives or substitutes and that the lack of competition is not due to an artificial narrowing of the terms of the acquisition.

An appeal against this direct acquisition must be lodged with the Finnish Market Court within 14 days of the publication of this notice.
Metsähallitus must be notified of the submission of a complaint to the Market Court at firstname.lastname@example.org.
The notice must mention the procurement case number MH 7135/2019.
The notification must be submitted at the latest when the appeal is submitted to the Market Court.
