MSS/0124 — Inservice Support of Rolls Royce WR21 and MT30 Gas Turbine Systems
The Marine Systems Support Output Business Unit (MSS), within the Defence Equipment and Support organisation (DE&S) which is part of the UK Ministry of Defence (‘the Authority’)), intends to place a contract for: In service Support of Rolls Royce WR21 and MT30 gas turbine systems.
The contract scope will cover Maintenance, Repair, Overhaul and Test (MRO&T); waterfront and onboard supply and technical support from 1 April 2021 through to December 2026.
Abschnitt IV: Verfahren
It is considered that this requirement can be placed using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons with Rolls Royce Defence Ltd operating through its subsidiary Rolls-Royce Power Engineering plc.
Rolls-Royce are the Original Equipment Manufacturer (OEM) for the equipment and have an in-depth knowledge of the design, production processes, overhaul specifications, manuals and associated repair test schedules. In addition, this equipment is supported by a complex supply base developed by the WR-21 OEM, managing UK and US sub-licensees in compliance with EAR 99 Export controls mandated by the US (Using NDA/TAA and MLA. Access to this OEM knowledge and supply base would not available to an alternative supplier.
The contract is for support of equipment specific to the T45 and QEC platforms with the overall market of these systems only used by UK Royal Navy. The equipment has been subject to extensive testing to prove characteristics such as shock tolerance, magnetic susceptibility and reliability. Any substitute product would require modification of the surrounding system or to the equipment itself and a corresponding qualification programme which would introduce unacceptable risks due to unavailability of access to platforms and equipment for system integration, validation, verification and qualification (IVVQ).
The technical information held by Rolls-Royce Power Engineering plc is necessary for performing this requirement to the safety levels required by the mandatory Safety of Life at Sea requirements. Failure to use Rolls-Royce Power Engineering plc would lead to significant safety issues due to denial of access to technical information in Rolls-Royce Power Engineering plc manufactured items by third parties which would be a significant hazard to health and equipment, which are unacceptable to the Authority.

The authority reserves the right to amend any condition related to security of information to reflect any changes in national law or government policy. If any contract documents are accompanied by instructions on safeguarding classified information (e.g. a Security Aspects Letter), the Authority reserves the right to amend the terms of these instructions to reflect any changes in national law or government policy, whether in respect of the applicable protective marking scheme, specific protective markings given, the aspects to which any protective marking applies, or otherwise.
