East Coast Main Line (EMCL) Digital Railway Train Control Partner
Network Rail Digital Railway is seeking to establish a single supplier Framework Agreement to deliver Digital Train Control Systems on the East Coast Main Line (ECML) route. The Framework Agreement comprises 2 main types of call-off contracts:
1) for outline design of the system; and/or
2) detailed design, build, supply and installation of the system together with ancillary conventional signalling as required to facilitate delivery of the digital system and long term (envisaged to be 30 years) maintenance of the system.

The overall geographical scope of the Framework Agreement is for the East Coast Main Line, which comprises the London North East (LNE) and East Midlands (EM) operational route (see procurement document).
On 10th May 2018 the Secretary of State for Transport and Network Rail set out a joint fifteen year digital train control strategy for the whole railway industry. This contract notice reflects that commitment by initiating the process to establish a Framework Agreement with a Train Control Partner (TCP) for the East Coast Main Line (ECML).
Under the Framework Agreement, it is envisaged that two main types of call-off contract may be awarded:
(i) Professional Services — terms and conditions are based on the NEC 4th edition form of contract and the scope of services may include preparation of outline designs for geographically defined schemes, support on development of alternative commercial and financial models and Outline Business Case and a Full Business Case (FBC) submissions should they be so required;
(ii) Design, Build and Maintain — the terms and conditions are based on the NEC 4th edition Design, Build and Operate form of contract adjusted for Maintenance. These call-off contracts may include preparation of a detailed design, supply of products, goods and services, installation, integration of an end to end system (including mobile and fixed telecommunications and existing / proposed assets) and commissioning of the designed system and once fully commissioned the TCP shall sustain the system performance for the life of the assets over the course of the 30 years maintenance phase.
Network Rail envisages that the first call-off contracts to be awarded pursuant to the Framework Agreement will be (1) a professional services contract for an outline design for a Train Control System covering the southern section of the route from London King Cross to Peterborough North; and (2) a design, build and maintain contract of a system for the Finsbury Park to Moorgate branch. Further details are set out in the procurement documents. These call-off contracts will form the focus of responses during the tender stage.
A Train Control Partner will be appointed under an initial 4 year term that may be extended to up to 8 years in annual increments. The call-off contract for design, build and maintenance will typically be of a duration of approx. 30 years from system commissioning.
Organisations wishing to express an interest in this framework must complete and submit a pre-qualification questionnaire (PQQ) by the date specified in Section IV.2.2. See procurement documents.

PQQ responses and resulting tenders from those who are shortlisted will only be accepted from an economic operator or group of economic operators that can deliver the full scope of works, services and supplies required under this contract notice. No specific legal form is required to be taken by a group of economic operators in order to participate in this procurement. However, Network Rail may require a consortium to assume a specific legal form if awarded the contract, to the extent that a specific legal form is deemed by Network Rail as being necessary for the satisfactory performance of the Framework. This framework forms part of a wider digital railway programme which will include separate procurements for a traffic management partner (TMP) to deliver traffic management and a railway systems integrator partner (RSIP) to provide programme support to Network Rail. As the RSIP is required to carry out an independent assurance role, the successful RSIP partner cannot also be awarded the TCP and/or the TMP roles. Further details are provided in the procurement documents.
Access: All access required to the trackside and to Rail Operating Centres will be co-ordinated with and approved by Network Rail.
Estimated total framework value: The figure stated in Section II.1.5 and Section II.2.6 is the current estimated maximum value of the call-off contracts envisaged to be placed over the duration of the framework (assuming it is extended). Network Rail envisages that the total estimated value of call-off contracts could be in the range of 1 000 000 000 GBP to1 800 000 000 GBP. Precise overall spend under the framework will depend on a number of factors including Control Period funding, the output of business case processes and/or performance under the framework.
Pre-qualification: Organisations wishing to express an interest in this framework opportunity must complete and submit a PQQ response by the date specified in Section IV.2.2. The draft Instructions to Tenderers is not currently part of the procurement document pack but it is envisaged that this will be loaded to the portal week commencing 20.8.2018. Interested organisations should note that the tender stage will include collaborative and behavioural assessment, including behavioural interviews and workshops.
Launch event: Details of a launch event were set out in a corrigendum notice (reference 2018/S 139-316988 and published on 21.7.2018) to the PIN referenced in Section IV.2.1. This launch event will take place on 6.8.2018 at 13:00 (GMT) the Central London venue is now confirmed as the Amba Hotel Marble Arch — Bryanston St, Marylebone, London W1H 7EH. Any interested organisation who has not already registered to attend this event should contact Network Rail via the email address in Section I.1.Attendance will be limited to a maximum of 3 representatives per organisation attending. Details of information presented at the launch event will be subsequently loaded onto Bravo for any organisation that is not able to attend.
Supplier session: Network Rail intends to hold a Q&A session with interested organisations to answer any clarification questions that an organisation may have in relation to this contract notice and the pack of procurement documents. The session is intended to take place on 28.8.2018 in London (date, time and venue to be confirmed). If an organisation is interested in attending this session, it must register with Network Rail via the email address in Section I.1. Again, attendance will be limited to a maximum of 3 representatives per organisation attending. Details of the Q&A will be subsequently loaded onto Bravo for any organisation that is not able to attend the session.
General: Network Rail reserves the right to change any aspect of or terminate this procurement and/or consider alternative procurement options. Under no circumstances shall Network Rail incur any liability (costs or otherwise) arising from an organisation expressing an interest in, preparing responses to and/or participating in this procurement.
In accordance with the Utilities Contracts Regulations 2016, Network Rail will incorporate a minimum 10 calendar day standstill period after notification of the outcome of the tender assessment to the economic operators who submitted a tender.
