DUD-Tender for VLR National Innovation Centre
Dudley Metropolitan Borough Council (DMBC) is seeking a suitably experienced contractor to tender for the design and construction of a new build National Innovation Centre (NIC), utility building, drainage and external works at recently cleared railway land adjacent to A4037 Tipton Road, Dudley, DY1 4AH. The NIC will be constructed on land owned by DMBC. This project will create the National Innovation Centre (NIC) for Very Light Rail (VLR) research. The NIC and associated external works will spur research, innovation and product design in very light rail, traditional rail, and motor vehicle technology:
— the NIC is part of a wider VLR masterplan which comprises a large reinforced concrete retaining wall, Test Track 1, Small Medium Enterprise (SME) building and Test Track 2,
— the NIC will enable companies to research and provide innovative solutions for manufacturing,
— the NIC will comprise research laboratories and offices and educational space to conduct seminars.

The restricted procedure will be used which is suitable as a large number of bidders are likely to be interested in participating. The number of bidders will be reduced at the selection stage based on their capacity, capability and experience to perform the contract. A tender list of shortlisted contractors will then be selected. The 2-stage procedure is described below:
Following a call for competition, any economic bidder may submit a request to participate in the selection stage. Bidders will be required to return a standard selection questionnaire.
Invitation to Tender (ITT) stage:
The ITT documents will be issued for completion by the 5 bidders successful at the stage 1 selection stage.

European Regional Development Fund (ERDF)
The NIC will provide research space, product development areas and education zones. NIC is part of a wider VLR masterplan which comprises a large reinforced concrete retaining wall, Test Track 1 SME building and Test Track 2. Although the budget is stated as 16 000 000 GBP this may be exceeded if additional funding is found elsewhere. The project may exceed the OJEU CAP of 16 000 000 GBP.

This exercise is being conducted in electronic format (e-tender). The Council expressly reserves the right:
1) Not to award any contract as a result of the procurement process commenced by publication of this notice;
2) To make whatever changes it sees fit to the content and structure of the tendering competition;
3) To award contracts in respect of any parts of the requirement covered by this notice; and
4) To award contract(s) in stages and in no circumstances will the Council be liable for any costs incurred by candidates.
The Council will incorporate a minimum 10 calendar days standstill period at the point information on award of the contract is communicated to tenderers. The contract Regulations 2015 (S12015 No 102) as amended provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be started within 30 days beginning with the date when the aggrieved part first.
Knew or ought to have known that grounds for starting proceedings had arisen. The Court may extend the time-limit for starting proceedings to be started more than 3 months after that date. Where a contract has not been entered into, the Court may order the settings aside of the award decision or order the Council to amend any document and may award damages. If the contract has been entered into the Court may only award damages or where the contract award procedures have not been followed correctly, declare the contract to be ineffective.
