Servicii de suport tehnic pentru produse aferente licentelor Oracle achizitionate pentru functionarea SIEGMCR, in conformitate cu specificatiile caietului de sarcini.

A) Termenul limita pana la care operatorul economic interesat de participarea la procedura de achizitie publica are dreptul de a solicita clarificari in legatura cu documentatia de atribuire, este de 20 zile inainte de termenul limita de depunere a ofertelor.

Autoritatea contractanta va raspunde in mod clar si concret la toate solicitarile de clarificari in a 11-a zi inainte de termenul stabilit pentru depunerea ofertelor.

B) Orice solicitare de clarificare transmisa dupa data mentionata la punctul A), va pune autoritatea contractanta in imposibilitatea de a oferi un raspuns in termenul mentionat la punctul B) si drept urmare orice solicitare de clarificare in termenele mentionate se va considera tardiva.

Procedura de atribuire a contractului de achizitie publica este initiata sub incidenta clauzei suspensive, in sensul ca incheierea contractului de achizitie publica este conditionata de alocarea creditelor bugetare cu aceasta destinatie, semnarea contractului facandu-se cu respectarea dispozitilor referitoare la angajarea cheltuielilor din bugetele care intra sub incidenta legislatiei privind finantele publice. Avand in vedere dispozitiile Legii nr. 98/2016 privind achizitiile publice, cu modificarile si completarile ulterioare si H.G. nr. 395/2016, cu modificarile si completarile ulterioare, Autoritatea Contractanta precizeaza ca va incheia contractul cu ofertantul declarat castigator numai in masura in care fondurile necesare achizitiei vor fi asigurate. In cazul in care indiferent de motive, creditele bugetare nu vor fi alocate, Autoritatea Contractanta isi rezerva dreptul de a anula procedura de atribuire, in conditiile in care nu exista o alta sursa de finantare, in conformitate cu prevederile art. 212 alin (1) lit. c) din Legea nr. 98/2016 cu modificarile si completarile ulterioare.

Ofertantii din cadrul acestei proceduri inteleg ca, Autoritatea Contractanta nu poate fi considerata responsabila pentru vreun prejudiciu in cazul anularii procedurii de achizitie, indiferent de natura acestuia si indiferent daca Autoritatea Contractanta a fost notificata asupra existentei unui astfel de prejudiciu.

Ofertantii din cadrul acestei proceduri accepta utilizarea conditiilor speciale mai sus/ clauzei suspensive, asumandu-si intreaga raspundere in raport cu eventualele prejudicii pe care le-ar putea suferi in situatia descrisa.
