Provision of Canteen and Catering Services at Eurofound
The main purpose of this tender is to contract a friendly, efficient provision and timely delivery of high-quality canteen and catering services at Eurofound. The main purpose of the hospitality service is to provide balanced, healthy and tasty food to staff and its visitors.
The tasks are to be performed at the Eurofound’s premises in Dublin (Ireland).
The successful contractor will be expected to provide the following services to Eurofound:
— on-going staff service (both breakfast and lunch) in the canteen;
— ad-hoc catering service for conferences, meetings and other events.
Note: TUPE or the Transfer of Undertakings Directive of 1977, which became part of Irish law by the European Communities (Safeguarding of Employees' Rights on Transfer of Undertakings) Regulations, 1980, protects the rights of employees where the business in which they are employed is transferred to a new owner, and is applicable to this contract. Previously awarded contract was terminated due to contractual matters. Accelerated procedure is required in order to ensure Eurofound's canteen being fully operational and available to staff as soon as possible.

The price propose by the only tender received for this contract was found to exceed the maximum amount set by Eurofound as determined and documented internally prior to launching the procurement procedure. As a result, the tender was judged to be unacceptable and rejected. Subsequently Eurofound has decided to cancel the procedure. A competitive procedure with negotiation without prior publication of a contract notice is planned to be used in order to ensure contract award.
Within 2 months of notification of the outcome of the procedure (award decision), tenderers may launch an action for its annulment. Any request tenderers may make and any reply from Eurofound, or any complaint for maladministration, will have neither the purpose nor the effect of suspending the time-limit for launching an action for annulment nor open a new period for launching an action for annulment. The body responsible for hearing annulment procedures is indicated under Heading VI.4.1) of the contract notice.
