An option is by law:

(a) Increasing the volume of management and maintenance service for PRM in relation to the duration of the system over individual years, i.e. extending the lifetime of the system by up to 3 months, except for the first year of PRM operation, up to a maximum of 1 month. An extension of the lifetime of PRM can be achieved for all or only part of the fleet — but not less than 300 bicycles.

An option is by law:

(a) Increasing the size of the management and maintenance service for PRM4G over the lifetime of the system, i.e. extending the lifetime of the system by up to 1 month in individual years. The extension of PRM4G can be carried out for all or only part of the fleet — but not less than 300 bicycles.

increase in the volume of the administration and maintenance of PRM4G as regards the number of bicycles and stopping zones operating in the system from one year to another. The maximum number of bicycles that the contracting authority may increase under the option law is 500 for the whole duration of the contract. Where there is an increase in the number of bicycles under the right of option, the number of bicycle parking spaces used is also increased, in terms of: 1 a zone for every 5 bicycles for which a primary contract is increased. PRM4G features triggered by exercising option rights shall be fully consistent with both a functional and visual PR4G system.

reduction of the size of PRM4G management and maintenance service for the number of bicycles and turnaround zones used in the system in different years. The number of bicycles may be reduced by no more than 20 % of the bicycles operating in the system per year. Section III: Legal, economic, financial and technical information

III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

The Contracting Authority, acting on the basis of art. 26 paragraph 1 of the Public Procurement Act shall, before awarding the contract, provide for the Contractor to whom the tender has been awarded at the most, in order to submit, within the prescribed time-limit, the following declarations and documents valid at the time of submission of the declarations or documents confirming that they fulfil the conditions for participation in the procedure and that there are no grounds for exclusion:

information from the National Criminal Register, to the extent specified in Article 24 paragraph 1 points 13, 14 and 21 of the Act, issued not earlier than 6 months before the deadline for submission of tenders or requests to participate;

a certificate of the head of the tax office concerned confirming that the economic operator has not been in arrears of the tax which was issued no earlier than 3 months before the deadline for the submission of tenders or requests to participate or another document confirming that the contractor entered into agreement with the competent tax authority on repayment of these duties together with any interest or fines, in particular he has obtained the exemption, deferral or payment in instalments of unpaid arrears or suspension in full of the decision of the competent authority;

a certificate on the suitability of the site of Zakład Ubezpieczeń Społecznych (Social Insurance Institution for Social Security) or another document confirming that an economic operator has not been in arrears with the payment of social security contributions or health contributions issued not more than 3 months before the deadline for the submission of tenders or requests to participate or another document certifying that the contractor has entered into an agreement with the competent authority to repay those duties together with any interest or fines, in particular he has obtained the exemption, deferral or payment in instalments of arrears or suspension in full of the decision of the competent authority;

(D) statements by the economic operator that a final administrative decision is taken on the payment of taxes, fees or social security contributions or social security contributions in arrears of taxes, fees or social security contributions or, in the case of such a judgment or decision, of documents certifying payment of such duty together with any interest or fines, or conclusion of a binding agreement on the reimbursement of these debts.

III.1.2)Economic and financial standing

The Contracting Authority shall consider that the condition is met if the Contractor demonstrates that he is insured for civil liability in respect of activities relating to the subject matter of the contract for not less than:

For part I: PLN 2 500 000,00 (in words: PLN) two million five hundred thousand 00/100)

For part II: PLN 2 500 000,00 (in words: PLN) two million five hundred thousand 00/100);

Or for both part of 5 000 000,00 PLN (in words: PLN) 5 million 00/100)

III.1.3)Technical and professional ability
List and brief description of selection criteria:

The contracting authority shall consider that the condition is met if the Contractor demonstrates that he has completed, during the last 3 years prior to the deadline for the submission of tenders, and if, during that period, the period of operation is shorter during the period of the submission of tenders:

Part I:

1.at least one service consisting of the activation of 1 (one) third-generation bicycle systems comprising at least 200 (two hundred) bicycles and 20 (twenty) cycle stations;

2) at least one single window service service over a minimum period of 6 (six) months at least 1 (one) third-generation bicycle systems comprising at least 200 (two hundred) bicycles and 20 (twenty) cycle stations;

Part II:

(1) at least one service consisting of the activation of 1 (one) stage of the fourth generation urban cycle of at least 200 (two hundred) bicycles;

2) at least one one-stop-shop service service for at least 6 (six) months or more of at least 1 urban bicycle of a generation fourth generation comprising at least 200 (two hundred) bicycles.
