Explanation:

Gemäß § 14 Abs. 4 Nr. 2 lit. c) VgV kann der öffentliche Auftraggeber Aufträge im Verhandlungsverfahren ohne Teilnahmewettbewerb vergeben, wenn der Auftrag wegen des Schutzes von ausschließlichen Rechten, insbesondere von gewerblichen Schutzrechten, nur von einem Unternehmen erbracht werden kann. Dieser Sachverhalt ist erfüllt, da es sich bei den vom Auftraggeber benötigten Lizenzen und den damit verbundenen Dienstleistungen um urheberrechtlich geschützte Werke handelt, die nur vom betreffenden Auftragnehmer bereitgestellt werden können.
