United Utilities Water (UUW) wishes to establish framework agreements and/or award contracts for works detailed below and this Notice is therefore a request for expressions of interest for consideration for inclusion on the list of applicants to be invited to tender for these framework agreements and / or contracts. UUW reserves the right not to award framework agreements and / or contracts for the works detailed in this Notice. Companies may apply individually and/or provide joint venture or consortium applications. Organisations already working with UUW under any other arrangement must still respond to this Notice in order to be considered for inclusion for the framework agreements and / or contracts falling within the scope of this Notice. UUW anticipates awarding framework agreements and / or contracts of up to 129 months duration, on the basis of an initial 69 month term plus at the end of the initial 69 month term an optional extension of a further 60 months. The deadline for responses to this Notice is 10.00am on Wednesday 20th November 2013. Applicants will be required to complete a pre-qualification questionnaire (PQQ), which will be used to assess applicants and determine those applicants who will be invited to tender. PQQs will be issued to applicants on receipt of their response to this Notice. Applicants will be required to complete the PQQ fully and return it to the address detailed in section I.1of this notice by 10.00am on Wednesday 20th November 2013.

The scope of the contract will include work classified as regulated in support of Developers creating new properties in the North West of England. This area of work is contestable and thereby Developers are not required to request these works to be carried out by the Company.

Section II.1.4: UUW reserves the right to appoint up to 3 (three) framework suppliers under this procurement. Any appointment will be on a non-exclusive, no volume guarantee basis and in the event more than one framework supplier is awarded this may be on a geographical basis in accordance with the published criteria.
Section II.1.9: Variants may be permitted if submitted in addition to a standard bid and providing the requirements for variants (set out in the tender documentation) have been met.
Section II.3 and II.2.2: Each framework agreement will be for an initial period of 69 months commencing 1.7.2014 plus at the end of the initial 69 month term an optional further 60 month period, making a maximum duration of up to 129 months. In addition to the 69 to 129 month period referred to above, UUW at its discretion may also require contractors selected for appointment to a framework agreement or contract to undertake additional works and / or services prior to the contract period referred to above. These works and /or services may include but are not limited to works and / or services to facilitate the transition from existing delivery arrangements.
Further information is available in the PQQ. Applicants are advised that no supporting or promotional material should be included in response to this Notice and all applicants must reply to the PQQ in the format stipulated in that document. UUW shall not be responsible for any costs, expenses or charges incurred by applicants and does not accept liability for any costs, expenses or charges incurred by the applicants, irrespective of the outcome of the tender process or in the event that the process is postponed or cancelled in whole or in part. UUW reserves the right not to award some or all of the framework agreements or contracts referred to in this notice.

Precise information on deadline(s) for lodging appeals: United Utilities Water Plc will incorporate a standstill period at the point information on the award of contract is communicated to tenderers. That notification will provide full information on the award decision. The standstill period, which will be for a minimum of ten calendar days, provides time for unsuccessful tenderers to challenge the award decision before the contract is entered into.
The Utilities Contract Regulations (SI 2006 No6) provide that aggrieved parties who have been harmed or at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland).
