Furnizare echipamente de protectie conform caietului de sarcini. Locul unde este specificata valoarea celui mai mare contract subsecvent pentru fiecare lot in parte se regaseste in „Lista loturi”, respectiv valoarea minima din intervalul valorii estimate fara TVA a fiecarui lot. Cuantumul garantiei de participare este de 1 % din valoarea estimata a celui mai mare contract subsecvent, conform Hotararii nr. 419/2018. Garantia de participare se poate constitui prin virament bancar in contul Spitalului Judetean de Urgenta Pitesti deschis la Trezoreria Pitesti, cod IBAN RO 40 TREZ 0465006 XXX 009193. Autoritatea contractanta va raspunde in mod clar si complet tuturor solicitarilor de clarificare/informatii suplimentare in a 10-a zi inainte de data-limita de depunere a ofertelor. Numarul de zile pana la care se pot solicita clarificari inainte de data-limita de depunere a ofertelor/candidaturilor este de 20 de zile.

Cantitatile minime si maxime estimate pe durata intregului acord-cadru, respectiv cantitatile minime si maxime care ar putea face obiectul unui singur contract subsecvent se regasesc la nivelul caietului de sarcini.

List and brief description of conditions:

Ofertanţii, ofertanţii asociaţi, terţii susţinători şi subcontractanţii nu trebuie să se regăsească în situaţiile prevăzute la art. 164, art.165şi art. 167 din Legea 98/2016.

Nedepunerea acestora odată cu DUAE (conf notificării ANAP 238/2017) constituie temei pentru solicitarea de clarificări pentru

Eventualele inadvertențe de formă ale informațiilor cuprinse în secțiunile DUAE, atât ale ofertantului/candidatului, cât și ale

Subcontractantului /terțului susținător, acest lucru fiind necesar pentru a asigura desfășurarea corespunzătoare a procedurii de

Atribuire.

Neîncadrarea în prevederile art. 59 (evitarea conflictului de interese), coroborat cu art. 60 din Legea 98/2016.

Ofertantul (inclusiv asociatul, tertul sustinator,) vor completa DUAE la procedura de atribuire cu informaţiile aferente situaţiei lor.

Toti participantii la procedura vor prezenta, odata cu depunerea DUAE, o declaratie conf art. 60 din Legea 98/2016.

În vederea completării declaraţiei si a formularului DUAE precizăm că persoanele cu funcţie de decizie în cadrul autorităţii

Operatorii economici ce depun ofertă trebuie să dovedească o formă de înregistrare în condiţiile legii din ţara de rezidenţă, din caresă reiasă că operatorul economic este legal constituit, că nu se află în niciuna dintre situaţiile de anulare a constituirii precum şi faptul că are capacitatea profesională de a realiza activităţile care fac obiectul contractului.

Modalitatea prin care poate fi demonstrata îndeplinirea cerintei: Se va completa DUAE de către operatorii economici participanţi la procedura de atribuire (lider, asociat, tert sustinator) cu

Informaţiile aferente situaţiei lor – partea IV, sectiunea A.

Atenționări speciale:

Documentele justificative care probează îndeplinirea celor asumate prin completarea DUAE, respectiv Certificat constatator emis de ONRC, sau în cazul ofertanţilor străini, documente echivalente emise în ţara de rezidenţă, urmează a fi prezentate la solicitarea autorităţii contractante, doar de către ofertantul clasat pe primul loc declarat admis/castigator in clasamentul intermediar.

Obiectul contractului trebuie să aibă corespondent în codul CAEN din certificatul Constatator.

La procedura de achizitie pot participa numai operatorii economici autorizati de Agentia Nationala a Medicamentelor si Dispozitivelor Medicale conform Ghidului privind buna practica de distributie angro in Romania.Avand in vedere cap. 7 art. 800 si urmatoarele din Legea nr. 95/2006 si tinand cont de Ordinul Ministrului Sanatatii 1963/2008, distributia angro de medicamente se face de catre posesorii unei autorizatii pentru desfasurarea activitatii de distribuitor angro de medicamente, care precizeaza sediul/sediile de pe teritoriul Romaniei pentru care este valabila, autorizatie eliberata de Agentia Nationala a Medicamentului si Dispozitivelor medicale.

Modalitate de indeplinire: se va completa DUAE urmand ca documentul justificativ sa fie prezentat la solicitarea autoritatii contractante doar de catre ofertantul clasat pe primul loc declarat admis/castigator in clasamentul intermediar.

Pentru operatorii economici straini se vor depune documente echivalente emise in tara de rezidenta

Documentele justificative prezentate în altă limbă vor fi însoţite de traducere autorizată în limba română

Ofertantul clasat pe locul 1 în clasamentul intermediar întocmit la finalizarea evaluarii ofertelor va prezenta, doar la solicitarea autoritatii contractante, bilant/ raport audit/ orice document relevant pentru sustinerea cifrei de afaceri.

Loturile: 1 Pentru contractele de achizitie de bunuri: executarea de livrari de tipul specificat Ofertantul va prezenta o lista PRIVIND PRINCIPALELE LIVRARI DE PRODUSE ÎN ULTIMII 3 ANI. Operatorii economici participanti la procedura de atribuire trebuie sa faca dovada ca au furnizat si dus la bun sfarsit in ultimii 3 ani, care vor fi calculati pana la data limita de depunere a ofertei cu mentiunea ca modul de calcul al perioadei nu va fi afectat de eventuale decalari ale termenului limita prevazut in Anuntul de participare, furnizari de medicamene prin contracte de furnizare care au valoarea cel putin egala cu valoarea cumulata a loturilor ofertate, lei fara TVA.

Documente suport pentru probarea cerintei: - Certificate/ documente / procese verbale de receptie / recomandari / copii ale contractelor, sau oricare alt document care sa confirme tipul produselor furnizate si valoarea acestuia. Modalitatea prin care se demonstreaza indeplinirea cerintelor: -Completare DUAE Documentele justificative urmeaza a fi prezentate doar de catre ofertantii clasati pe primele 3 locuri în clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.
