DfI:2309911 — Belfast Tidal Flood Alleviation Scheme
The objective of this procurement is for the provision of develop and build services by an Economic Operator’s Team (EOT). The EOT will complete the detailed develop and build of a tidal flood defence for Belfast along the tidal reach of the River Lagan, The defence is approx 8,6 km long from Stranmillis Weir on Lockview Road to Northern Road in Belfast Harbour Estate. The defence will comprise a combination of concrete flood walls, sheet pile flood walls, bored pile flood walls, walls with security fencing/railings, glass flood walls, demountable barriers (normally installed and normally stored), temporary barriers and flood gates. The contract also includes demolition of existing boundary walls along the line of defence, wall cladding, back drainage, hard and soft landscaping along the scheme, landowner and stakeholder consultations, all necessary permissions, licences, permits, consents and approvals, and completion of lands agreements.

In accordance with Regulation 65(3) of the Public Contract Regulation 2015, 5 candidates will be invited. This offers adequate competition to ensure that the employer is assured value for money and that there is sufficient opportunity offered to tenders. However, this limit also protects the industry from wasting valuable resources which are required to prepare a tender submission. It is anticipated that the 5 No economic operators that; satisfy the completeness and compliance checks, the criteria for the selection of economic operators, the information as to economic and financial standing, and who achieve the highest scores in the technical or professional ability evaluation process will be short-listed and invited to submit tenders. Where there is a tie for 5th place, then all economic operators in 5th place will be invited to tender. For the purposes of this exercise a tie for 5th place is deemed to occur where 2 or more economic operators have identical scores or a score within 1 mark (out of a score of 100) of the 5th place score.
Award criteria is as set out in the draft instructions to tenderers document for the ITT competition. The contract will be awarded to the economic operator which has submitted the Most Economically Advantageous Tender (MEAT) using as applicable the AvgL3 Price Scoring Mechanism.
Section III: Legal, economic, financial and technical information
In order for a contractor/consultant to be eligible to participate in this competition they must hold licenses, accreditations or certificates for specific categories and sectors as set out in the PQQ documents.
The Economic Operators’ (EO) performance will be regularly monitored. If an EO has received more than 1 current notice of written warning or a notice of unsatisfactory performance, the CA, at its discretion, can consider an economic operator’s exclusion from future procurements, being undertaken on behalf of bodies covered by the Northern Ireland Public Procurement Policy (NIPP), for a minimum period of 12 months or 3 years respectively. CPD, in its capacity as a central purchasing body, is administering this procurement on behalf of the Contracting Authority. The Contracting Authority expressly reserves the right:
(i) not to award any contract/framework agreement as a result of the procurement process commenced by publication of this notice or to cancel the procurement at any stage; and
(ii) to make whatever changes it may see fit to the content and structure of the tendering competition and in no circumstances will the Authority be liable for any costs incurred by economic operators or candidates. Any expenditure, work or effort undertaken prior to contract award is accordingly at the sole risk of the economic operator or candidate participating in this procurement process. This project will be used to progress the Government’s wider social, economic and environmental objectives.
No business whatsoever is guaranteed under any resulting framework agreement or contract indeed there is no guarantee that any framework agreement or contract will be put in place in relation to this notice. No compensation, etc. will be paid if a contract or framework agreement is withdrawn for any reason. Economic operators should take part in this process only on the basis that they fully understand and accept this position.

This procurement is governed by the Public Contracts Regulations 2015 and provides for economic operators who have suffered, or who risk suffering, loss, or damage, as a consequence of an alleged breach of the duty owed in accordance with Regulation 91 to start proceedings in the High Court. A standstill period will commence at the point information on the award of the contract is communicated to tenderers. That notification will provide information on the award decision. The standstill period, which will be for a minimum of 10 calendar days, provides time for unsuccessful tenderers to challenge the. award decision before the contract is entered into.
