Acord-cadru furnizare alimente diverse 2021. Atribuirea acordului-cadru se va face cu maximum trei operatori conform prevederilor Legii 98/2016, art. 118 alin. (1) lit. a) „fără reluarea competiţiei, în conformitate cu termenii şi condiţiile prevăzute în cuprinsul său, în cazul în care acordul-cadru stabileşte toţi termenii şi condiţiile care reglementează execuţia lucrărilor, prestarea serviciilor şi furnizarea produselor care constituie obiectul său, precum şi condiţiile obiective în funcţie de care se stabileşte care dintre operatorii economici parte la acordul-cadru va executa lucrările, va presta serviciile sau va furniza produsele”. Acordul-cadru se va încheia cu maximum trei operatori economici, dar fără reluarea competiţiei, în ordinea clasamentului. Principalul furnizor este cel clasat pe locul I, iar în cazul în care acesta nu îşi poate menţine preţul ofertat sau nu poate asigura livrarea solicitată, se va atribui contractul subsecvent următorului clasat. Contractele subsecvente pot fi incheiate in functie de necesitati, de regulă trimestrial.

Termenele in care autoritatea contractanta va raspunde, in mod clar si complet, tuturor solicitarilor de clarificare/informatii suplimentare solicitate de operatorii economici interesati: cu 20 de zile inainte de termenul-limita de depunere a ofertelor. Numarul de zile pana la care se pot solicita clarificari inainte de data-limita de depunere a ofertelor este de 20 de zile. Autoritatea contractanta va raspunde solicitarilor de clarificari primite in a 11-a zi inainte de data-limita de depunere a ofertelor.

Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art.59-60, 164, 165, 167 din Legea nr.98/2016.

Modalitatea de indeplinire: - se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Ofertantii,tertii sustinatori si subcontractantii nu trebuie sa se regaseasca în situatiile prevazute la art.164,165,167 din Legea nr.98/2016.

Atenționare specială: nedepunerea odată cu oferta, a DUAE, a angajamentului ferm al terțului susținător din care rezultă modul efectiv în care se va materializa susținerea acestuia, sau după caz, a acordului de subcontractare și/sau a acordului de asociere, atrage respingerea acesteia ca ofertă inacceptabilă

DUAE se va depune, de catre tertul sustinator si de subcontractant, daca este cazul.

Certificat constatator, detaliat, emis de Oficiul National al Registrului Comertului (diferit de certificatul de înregistrare) al judetului unde firma îsi are sediul privind date de identificare ale societatii; filiale; sucursale; puncte de lucru; administratori; reprezentanti; împuterniciti; durata societatii; actionari/ asociati; obiect de activitate (cod CAEN). Documentul se va accepta in oricare din formele- original/copie legalizata sau copie lizibila cu mentiunea conform cu originalul. Se mentioneaza ca este permisa prezentarea documentului si în forma electronica, având încorporata, atasata sau logic asociata semnatura electronica extinsa. In etapa evaluarii ofertelor, autoritatea contractanta va solicita ofertantului clasat pe primul loc, inainte de transmiterea comunicarii privind rezultatul procedurii de atribuire, de a prezenta pentru conformitate documentul in original/copie legalizata. Informatiile din Certificatul constatator trebuie sa fie reale/valide la data prezentarii acestuia.

Înainte de atribuirea acordului cadru, autoritatea contractanta va solicita ofertantilor clasati pe primele trei locuri dupa aplicarea criteriului de atribuire, sa prezinte documentele justificative actualizate prin care sa demonstreze îndeplinirea tuturor criteriilor de calificare, în conformitate cu informatiile cuprinse în DUAE.

Operatorii economici vor fi obligati sa prezinte documentele solicitate in sustinerea experientei similare doar la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor. In DUAE, ofertantii vor indica informatii privind experienta similara, astfel: nr. si data contractului invocat, beneficiarul acestuia si datele sale de contact, nr. si data documentului de receptie, precum si valoarea acestuia, fara TVA. Documentele justificative ce vor fi prezentate pentru îndeplinirea criteriilor privind capacitatea mai sus mentionata, la solicitarea autoritatii contractante, de catre ofertantii (in cazul unei asocieri, fiecare membru al asocierii în masura în care experienta sa este relevanta pentru proiect) clasati pe primele trei locuri, dupa aplicarea criteriului de atribuire, pâna la data încheierii raportului de atribuire, conform art. 196 alin.
