Beauftragung offener Leistungsteile in der LP 9 mit Anpassung der Vergütungsgrundlage - Anpassung Vertrag an aktuelles Bausoll

Einsatz eines Taucherkomplexes für die visuelle Kontrolle des Voll- und Teilvergusses der elbseitigen Wasserbausteine im Zulaufbereich des Wehres als Vorraussetzung für die Zustandsfeststellung vor Freigabe zum Überbauen der Sohlsicherung

Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Fertiggestellte Bauteile sind für ein Überbauen darauf aufbauender Bauteile freizugeben.

Dies erfolgt über Zustandsfeststellungen oder Teilabhnahmen. Die Bauoberleitung ist vertraglich für die Erteilung der Freigaben zuständig .Damit liegen diese Freigaben im Bereich der Gewährleistung der Bauoberleitung.Grundlagen zur Freigabe sind die Dokumantation und Prüfung der vertragskonformen Leistungserbringung anhand von Eignungs- und Kontrollprüfungen. Zur Kontrollprüfung geört auch die visuelle Beurteilung, bei Unterwasser hergestellten Leistungen erfolgt dies über Ingenieurtaucher.
