CPD is establishing this Agreement as a Central Purchasing Body on behalf any public sector organisation in Northern Ireland. The Framework Agreement will be awarded for a period of 4 years, with the option to terminate at the end of Year 1, Year 2, Year 3 or at any time as may be deemed necessary by the Contracting Authority. The Contracting Authority reserves the right to extend the period of the Framework Agreement for an additional year beyond the 4 years if necessary to ensure continuity of service to all clients.

Objective criteria for choosing the limited number of candidates:

Envisaged that the number of candidates per Lot is 6 and an Economic Operator may be a candidate for both Lots. In the event that an EO is successful in being awarded Lot 1 but fails to perform satisfactorily, enters into administration or is otherwise unable to undertake the specified works, the Contracting Authority may award some or all of the works required under Lot 1 to the EO who was awarded Lot 2 for the remaining duration of the Framework Agreement.

The Economic Operators’ (EO) performance will be regularly monitored. As part of its contract management procedures, the Contracting Authority (CA) will use the Protocol for Managing Poor Supplier Performance contained in Procurement Guidance Note PGN 01/12 – Contract Management Principles and Procedures: https://www.finance-ni.gov.uk/publications/procurement-guidance-note-0112-contract-management-principles-and-procedures. If an EO has received more than one current Notice of Written Warning or a Notice of Unsatisfactory Performance, the CA, at its discretion, can consider an. Economic Operator’s exclusion from future procurements, being undertaken on behalf of bodies covered by the Northern Ireland Public. Procurement Policy (NIPP), for a minimum period of 12 months or 3 years respectively. A list of bodies subject to Northern Ireland Public. The Pan Government Collaborative Framework Agreement for Civil Engineering Minor Works 2019 is being let by Construction and Procurement Delivery on behalf of any public sector organisations requiring services in Northern Ireland including: Government Departments; Agencies; Non-departmental Public Bodies; Local Authorities; or other Contracting Authority (including subsidised bodies or other grant recipients). A list of potential organisations is included in the tender documents. This Framework Agreement may be used to progress the Government’s wider social, economic and environmental objectives. A list of potential users can be viewed at https://www.finance-ni.gov.uk/publications/list-framework-users-pan-government-collaborative-civil-engineering-minor-works. The Contracting Authority expressly reserves the right to award one, some, all or no Lots;

(ii) not to award any contract/framework agreement as a result of the procurement process commenced by publication of this notice or to cancel the procurement at any stage; and

(iii) to make whatever changes it may see fit to the content and structure of the tendering competition and in no circumstances will the Authority be liable for any costs incurred by Economic Operators or Candidates. Any expenditure or work undertaken prior to Framework Agreement award is accordingly at the sole risk of the Economic Operator or Candidate participating in this procurement process. This project will be used to progress the Government’s wider social, economic and environmental objectives. The award criteria are set out in the Instruction to Tenderers Documents. Economic Operators will be subject to performance monitoring and may be suspended from being able to participate in the Framework Agreement or may be terminated from the Framework Agreement. Step in clauses may be used, in accordance with the conditions of the Framework Agreement, to award a call-off to an Economic Operator appointed to another Lot, if the Economic Operator designated to a particular Lot is not performing satisfactorily. There is no guarantee that a Framework Agreement will be put in-place as a result of this competition. Furthermore, there is no guarantee that any contracts will be awarded under any resulting Framework Agreement. No compensation will be paid in the event that the Framework Agreement is not concluded and or the level of contracts awarded under the Framework Agreement is not as anticipated by the winning Economic Operators. No business whatsoever is guaranteed under any resulting Framework Agreement or contract indeed there is no guarantee that any framework agreement or contract will be put in place in relation to this notice. No compensation etc will be paid if a contract or Framework Agreement is withdrawn for any reason. Economic Operators should take part in this process only on the basis that they fully understand and accept this position.
