 Die benötigte Leistung kann nur Fa. SAP Deutschland SE & Co. KG erbringen (§ 12 Abs. 2 Nr. 1 Buchst. c) VSVgV).Insbesondere sind für die Leistungserbringung Eingriffe auf Quellcodeebene erforderlich, die lizenzrechtlich dem Hersteller vorbehalten sind. Neben benötigten Lizenzrechten und der Komplexität der mehr als 50 stark vernetzten vorhandenen IT-Systeme ist die Leistungserbringung durch den Hersteller Fa. SAP bedingt durch Anforderungen betreffend die Sicherheits- und Ausfallrisiken erforderlich.Zudem beinhaltet die Leistung den unmittelbaren Zugriff auf die Entwicklungsabteilung des Herstellers, den ein anderer Auftragnehmer nicht zur Verfügung stellen kann.
