Autoritatea contractanta va accepta in cadrul ofertelor DUAE (Documentul Unic de Achizitie European) in locul documentelor solicitate in vederea demonstrarii cerintelor de calificare, inclusiv a capacitatii de exercitare, ca dovada preliminara. DUAE poate fi descarcat in vederea completarii si depunerii de la adresa https://ec.europa.eu/growth/toolsdatabases/espd/filter (instructiuni privind completarea DUAE sunt disponibile la adresa www.e-licitatie.ro). Înainte de atribuirea acordului cadru, autoritatea contractanta va solicita ofertantilor clasati pe primele 3 locuri semnatare ale acordului cadru dupa aplicarea criteriului de atribuire, sa prezinte documentele justificative actualizate prin care sa demonstreze îndeplinirea tuturor criteriilor de calificare, în conformitate cu informatiile cuprinse în DUAE. DUAE se va depune, dupa caz, si de catre subcontractanti sau terti sustinatori. În cazul operatorilor economici straini se vor prezenta documente echivalente emise în conformitate cu legislatia aplicabila în tara de rezidenta.

1.Certificat constatator emis de Oficiul Registrului Comertului, din care sa rezulte adresa actuala si obiectul de activitate al respectivului operator economic. Obiectul contractului trebuie sa aiba corespondent in codul CAEN din certificatul constatator emis de O.N.R.C.Informatiile cuprinse in acesta trebuie sa fie reale/actuale la data prezentarii documentului. Inainte de transmiterea comunicarii privind rezultatul procedurii de atribuire, ofertantilor clasati pe primele 3 locuri semnatare ale acordului cadru li se vor solicita sa prezinte ptr. conformitate documentul in orginal/ copie legalizata in situatia in care a fost prezentat in forma copie conform cu originalul sau in format electronic. Operatorii straini vor demonstra indeplinirea cerintelor completand DUAE.

Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv documentele echivalente, emise in tara de rezidenta, urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor (art.173 din Legea 98/2016). Urmatoarele documente justificative care probeaza îndeplinirea cerintei vor fi prezentate, la solicitarea autoritatii contractante, de catre toti ofertantii care au depus oferte admisibile cf.art.196 alin (2) din Legea 98/2016.Acestea pot fi: - Bilanturi contabile sau extrase de bilant sau alte documente emise de organisme specializate care confirma nivelul cifrei de afaceri înscris în DUAE. În cazul depunerii unei oferte comune, DUAE va fi completat de catre fiecare operator economic în parte. Se solicita tuturor ofertantilor,ca odata cu depunerea DUAE sa prezinte acordul de asociere.Documentele care probeaza cele asumate prin acorduri vor fi solicitate doar ofertantului declarat castigator la solicitarea aut ctr. Documentele justificative pot fi prezentate în oricare din formele original/copie legalizata/copie certificata pentru conformitate cu originalul. Certificarea pentru conformitate se face de catre reprezentantul legal/împuternicit al al operatorului economic prin înscrierea pe fiecare pagina a mentiunii "conform cu originalul", însotita de semnatura persoanei respective.
