III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers
List and brief description of conditions:

Each tenderer must submit with its tender a completed European Single Procurement Document (ESPD), a relevant declaration replacing the documents issued by the competent authorities and provisionally certifying that the qualifications of the supplier and of the entities on which it relies comply with the qualification requirements set out in the procurement documents and do not contain grounds for exclusion. In the case of a consortium of economic operators operating under a joint venture/partnership agreement, the ESPD shall be provided for each member of the consortium separately. Where the contractor makes use of subcontractors, subcontractors or subcontractors (‘subcontractors’) or other economic operators (experts or specialists planned to be employed by the supplier’s undertaking in the event of the award of the contract, etc.), the ESPD of those entities shall also be provided together with the supplier’s ESPD. The contracting authority will require proof of eligibility only from the tenderer whose tender will be recognised as a potential winner after the ranking of the tenders has been established. These documents will have to be submitted within 3 (three) working days from the date of dispatch of the contracting authority’s individual communication by means of correspondence between the CVP IS (the supplier will have to provide a digital copy of the requested documents in electronic form by means of correspondence between the CVP IS). The contracting authority reserves the right to request original copies of the digital documents submitted).

III.2.2)Contract performance conditions:

Securing the performance of the contract – penalties. Where the contracting authority terminates the contract for reasons attributable to the contractor or in case of non-performance or improper performance of the contract by the contractor, the contractor shall, at the request of the contracting authority, pay the contracting authority a penalty of 10 (ten) % of the value of the contract, including VAT, within 10 (ten) calendar days from the dispatch of the call. Payment of the penalty shall not relieve the supplier of the obligation to compensate for the direct loss suffered by the contracting authority in the event of non-performance or improper performance of the contract by the contractor, to the extent that the loss suffered exceeds the penalty.

Justification:

Access to the tenders submitted by the suppliers was to take place on 20.07.2021, but the notice completed and placed on the contract work 2021 06 14 was not made public for technical reasons and was discovered only during the opening procedure. Following the announcement by the World Health Organisation of the pandemic of the outbreak of the 2019-nCoV/SARS-CoV-2 (COVID-19) virus, a quarantine has been declared in many countries, leading to a disruption in the delivery of supplies, and it is essential for the contracting authority, as an institution of public interest, to ensure that patients are continuously tested.

The contracting authority will carry out procurement procedures by means of an accelerated procedure, ensuring competition between suppliers, compliance with the principles of transparency, non-discrimination and non-discrimination, in order to ensure the most expeditious availability of supplies.
