IV.1)Description
IV.1.1)Type of procedureAward of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
- New works/services, constituting a repetition of existing works/services and ordered in accordance with the strict conditions stated in the directive
Explanation:
Within the first three years of the contract, the Contracting Authority may use the negotiated procedure without prior publication of a contract notice regardless of the estimated value of the contract, for new services or works consisting in the repetition of similar services or works entrusted to the economic operator to which the same Contracting Authority awarded an original contract, provided that these services or works are in conformity with a basic project for which the original contract was awarded after publication of a contract notice. The possible use of the negotiated procedure without prior publication of a contract notice for the purpose of the increase of the financial ceiling has been disclosed in the tender document as soon as the first contract was put out to competitive tender. The services in scope of the requested increase do not exceed 50 % of the initial contract value and consist in the repetition of similar services entrusted to the current contractor which are in full conformity with the basic project for which the original contract was awarded.
