The contracting authority shall require the Contractor, whose offer has been at most to be assessed, to submit the following documents: (1) List of persons assigned by the Contractor to the performance of the public contract, in particular those responsible for the provision of services, including information on their professional qualifications, powers, experience and training necessary for performing the contract, and the scope of their activities and information on the basis of their disposal. For joint contractors: 1) Compliance with the conditions of participation in the proceedings of the Contractor shall show a total. The contracting entity does not specify a particular way of fulfilling the condition of the joint contractors; (2) None of them may be excluded in the circumstances referred to in Article 24 (1). 1 and paras. 5 points 1 of the Act. Each joint Contractor shall submit jointly with the tender the ONE declaration constituting a declaration confirming that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure. Rules on the use of other entities’ resources to confirm that the conditions for participation in the proceedings are met: (1) the Contractor may, in order to confirm that the conditions for participation are met, where appropriate and for a particular contract or part of it, rely on the technical or professional capacities of other entities, irrespective of the legal nature of the legal relationship between them; (2) An economic operator who relies on the capacities or situations of other entities must prove to the Contracting Authority that, in the performance of the contract, it will have at its disposal the resources of those entities, in particular by providing an undertaking by those entities to place the resources necessary for the performance of the contract; (3) The contracting authority will assess whether the Contractor made available to the Contractor by other bodies technical or professional capacities permit the Contractor to demonstrate compliance with the conditions for participation in the procedure and whether the grounds for exclusion referred to in Article 24 (1) are not being applied to that operator. 1 and paras. 5 points 1 of the Act; (4) As regards conditions relating to education and professional qualifications, the Contractor may rely on the capacities of other entities where those entities will implement the services to which those capacities are required; (5) If the technical or professional capacity of the entity referred to above does not confirm fulfilment of the conditions of participation by the Contractor or grounds for exclusion, the Contracting Authority will require the Contractor to meet within the time limit set by the Contracting Authority: (a) replace that entity with another entity or entities, or; (b) undertake to carry out the relevant part of the contract in person if it demonstrates the technical and professional capacities referred to below. Contracting authorities pursuant to Article 24aa) 1 of the Public Procurement Act, as a first step, will assess the bids submitted and then examine whether the Contractor whose bid has been assessed as the most advantageous is not excluded and meets the conditions for participation in the procedure.

With regard to the persons assigned by the Contractor to perform the contract, i.e.: 1) References to PART No: 1, 2, 5, 8, 10, 12: The contracting authority shall require the Contractor to demonstrate a team of persons assigned to performing a contract which shall include at least two persons with professional competence to perform independent functions in geodesy and cartography within the meaning of the Law of 17 May 1989 on surveying and cartography within the scope of: geodetic measurements of situational awareness, altitude, implementation and inventory; 2) References to PART No: 3, 4, 7, 9, 11: The contracting authority shall require the Contractor to demonstrate a team of persons assigned to performing the contract, comprising: (a) two or more persons with professional qualifications to perform independent functions in geodesy and cartography within the scope of the Geodetic and Cartographic Law Act of 17 May 1989 on: geodetic measurements of situational awareness, altitude, implementation and inventory; two or more persons with professional qualifications to perform independent functions in geodesy and cartography within the scope of the Geodetic and Cartographic Law Act of 17 May 1989 on: demarcation and division of land (land) and legal documentation. note (for all lots): The contracting authority shall allow the same person to be shown if he or she has a professional competence in several of the within/within ranges. In the event of a tender being submitted by the Contractor in several lots, the Contracting Authority shall allow the same persons to be shown to be able to demonstrate compliance with the conditions for participation in the procedure for the various lots. Whenever the Contracting Authority requires certain geodetic powers on the basis of the Geological and Cartographic Law currently in force of 17 May 1989, this also means the corresponding important powers, issued on the basis of previously applicable legislation, and the corresponding important powers

In the field of surveying and cartography within the Republic of Poland under the relevant provisions of the law of the Member States of the European Union, the Swiss Confederation or the Member States of the European Free Trade Agreement (EFTA) which have acquired the right to carry out certain regulated professions or activities where those qualifications have been recognised in accordance with the rules laid down in the Act of 22 December 2015 on the rules for the recognition of professional qualifications acquired in the Member States of the European Union (Polish Journal of Laws of 2018, item 2272) and implementing acts, in accordance with the provision of Article 87 of that Act, the body competent for the recognition of professional qualifications in the field of geodesy and cartography is the General Geodal of Poland under the Regulation of the Minister for the Interior and Administration of 2 March 2010 on the authorisation of authorities to recognise qualifications in regulated professions (Dz. Journal of Laws No 45, item 268, as amended).

1) In order to pre-certify that the Contractor is not subject to exclusion and meets the conditions for participation in the procedure, the Contractor shall submit a declaration on the day on which the tenders are submitted in the form of the Single Market. (2) the Contractor shall have 3 days from the date of publication of the information referred to in Article 86 (5) of the Public Procurement Act to confirm the absence of grounds for exclusion from the proceedings referred to in Article 24 (1) of the Procurement Act. 1 points 23 of the Public Procurement Act provides the Contracting Party with a declaration of whether or not they belong to the same group. 3) In order to confirm the absence of grounds for the exclusion of the Contractor from the procedure, the Contracting Authority will require the Contractor, whose tender has been the subject of a maximum of the following documents, to submit his tender: information from the National Criminal Register within the scope of Article 24 (3). 1 points 13, 14 and 21 of the Public Procurement Act, which have been issued no earlier than 6 months before the closing date for the submission of tenders or requests to participate; a statement by the Contractor that there is no final court judgment or final administrative decision on the payment of taxes, fees or social security contributions or, in the event of such a judgment or decision, documents proving the payment of such taxes, including any interest or fines, or the conclusion of a binding agreement on the repayment of those duties; a statement by the contractor that no decision has been made against him as a precautionary measure against the fact that it is prohibited to apply for public contracts; (D) a copy of the relevant register or of a central register and information on the economic activity where separate provisions require an entry in the register or records in order to confirm the absence of grounds for exclusion pursuant to Article 24 (1). 5 points 1 of the Public Procurement Act. 4) If the Contractor is established outside Poland, instead of the documents in question: (a) in point (a) 3.a) shall submit the information from the relevant register or, in the absence of such a register, any other equivalent document issued by a competent judicial or administrative authority in the country in which the person to whom the information or document relates has his registered office or place of residence, within the limits laid down in Article 24 (3). 1 points 13, 14 and 21 of the Public Procurement Act, issued at least 6 months before the closing date for submission of tenders; (b) in point 3.d) submits the document or documents issued in the country in which he is established confirming that a winding-up has not been opened or declared bankrupt, no earlier than 6 months before the closing date for the submission of tenders. Remedies shall be granted to the Contractor and to another body if he has or has had an interest in obtaining the order and has suffered or is likely to be harmed by an infringement by the Contracting Authority of the provisions of the Act. 1) An appeal may be brought only against an unlawful act of the contracting authority in the context of a procedure for the award of a contract or of an act which the contracting authority is required to act on the basis of the Act; 2) The appeal must indicate the act or omission of the contracting authority alleged to be in non-compliance with the provisions of the law, contain a summary of the pleas in law, set out the request and indicate the circumstances of fact and of law justifying the lodging of the appeal; (3) Appeal shall be submitted to the President of the National Chamber of Appeal either in paper form or in electronic form, duly signed by hand or by a qualified electronic signature, respectively; (4) The Appellant is required to send a copy of the appeal to the Contracting Authority before the expiry of the time limit for lodging an appeal in such a way that he can take note of that appeal before the expiry of that period. The contracting authority shall be deemed to have become aware of the content of the appeal before the expiry of the period for lodging it, if the copy of the appeal was sent before the expiry of the time-limit for bringing the appeal in question by means of electronic communication; (5) Appeal shall be lodged within 10 days from the date on which the contracting authority is informed of the act on which it is based, if it has been sent using electronic means of communication or within 15 days if it has been sent by other means; (6) Appeal against the text of the contract notice and the provisions of the Specifications shall be lodged within 10 days from the date of publication of the notice in the Official Journal of the European Union or listing the specifications on the contracting authority’s website; (7) Appeal against other acts of the contracting authority must be lodged within 10 days of the date on which, or on the exercise of due diligence, the person concerned could reasonably have been aware of the circumstances which gave rise to that appeal.
