III.1.1)Deposits and guarantees required:
A bank guarantee of 10 % of the tender's overall value will be required prior to contract signature.

Payment at 30 days as stated in the provisions of the draft contract appended to the specifications.

Each individual grouping member must comply with the non-exclusion criteria. The grouping as a whole must comply with the selection criteria (see points III.2.2 and III.2.3) and the different grouping members will be jointly and severally liable for contract performance.

Description of particular conditions: selected candidates will receive the specifications only if they have first signed a declaration to respect the confidentiality of the information to which they have access under this invitation to tender and the performance of the project in question. The content of this declaration can be found in point III.2.1) D.
III.2)Conditions for participation
III.2.1)Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers
Information and formalities necessary for evaluating if the requirements are met: A. Dispatch of applications:
requests to participate must be sent in a letter posted no later than the date given in point IV.3.4 of this notice.
Faxed or e-mailed requests to participate must be confirmed by a letter posted before the same date.
Requests to participate must be sent in a double envelope. Both envelopes must be sealed and the inner one must be marked with both the name of the department which it is addressed to (see above) and the following: 'OIB/DR2/PR/2014/085/644 — Demande de participation de (candidate's name) — À ne pas ouvrir par le service du courrier'.
Self-seal envelopes must be sealed with adhesive tape, with the sender's signature written across the tape.
Candidates may elect to send their requests to participate:
(a) either by post or courier addressed to the official address in point I.1 of this notice. In this case, the date of dispatch will be evidenced by the postmark or the date on the delivery receipt;
(b) or by delivering them straight to the European Commission's Central Mail Department, either in person or via any representative of theirs, courier services included. In this latter case, the official address given in point I.1 of this notice must be written on the outer envelope. Confirmation that the request to participate has been delivered will be in the form of a dated receipt issued by the European Commission's Central Mail Department. The address of the European Commission's Central Mail Department is avenue du Bourget 1, 1140 Brussels (Evere), BELGIUM. Its opening hours are 8:00–17:30, Monday to Friday, Commission holidays excepted.
B. Candidate's references:
the candidate (or each member in the case of groupings) must:
— quote reference 'OIB/DR2/PR/2014/085/644' in his request to participate,
— enclose identity details (groupings shall provide these separately for each member and state which is the lead company) as follows: name, legal status, nationality, address, telephone and fax numbers, contact name and e-mail address, VAT number and legal registration number (where applicable),
— enclose the documents and information required under point III.2 'Conditions for participation' (groupings must furnish separate documents and information for each member).
C. Legal position:
the candidate shall enclose documentary proof with the name of the country in which he has his head office or is domiciled, as required under law in his country of residence.

The candidate must enclose a duly signed and dated solemn declaration stating that he is not in any of the situations which would exclude him from participating in a contract awarded by the European Communities. NB: the successful tenderer must, on pain of exclusion, furnish the following documentary evidence in support of the solemn declaration prior to signature of the contract:
— recent extract from the judicial record or, failing this, an equivalent document recently issued by an appropriate judicial or administrative body in the country in which the tenderer resides, stating that he is not bankrupt or being wound up, his affairs are not being administered by the court, he has not entered into an arrangement with creditors, he has not suspended business activities, he is not the subject of proceedings of this nature, nor is he in any analogous situation arising from a similar procedure under national laws or regulations,
— recent extract from the judicial record or, failing this, an equivalent document recently issued by an appropriate judicial or administrative body in the country in which the tenderer resides, stating that he has not been convicted of an offence concerning his professional conduct by a judgment which has the force of 'res judicata' and has not been the subject of a judgment which has the force of 'res judicata' for fraud, corruption, involvement in a criminal organisation or for any other illegal activity detrimental to the Union's financial interests,
— recent certificate issued by an appropriate body in the country in which the tenderer resides, stating that he has fulfilled his obligations in respect of payment of social security contributions,
— recent certificate issued by an appropriate body in the country in which the tenderer resides, stating that he has fulfilled his obligations in respect of payment of taxes (direct taxes and VAT) in accordance with legal provisions in said country.
Where no such documents or certificates are issued in the country concerned, they may be replaced by a statement under oath, or failing that, a solemn declaration made by the candidate before a judicial or administrative body, a notary or a qualified professional body in the candidate's country of residence.
NB: groupings must provide the solemn declaration along with the supporting documents and information, in the event they are awarded the contract, for each individual member.
D. Confidentiality declaration:
selected candidates will only receive the specifications if they have first signed the following confidentiality statement:

This commitment shall be unlimited.
In particular, I acknowledge that I have been informed that I cannot disclose to a third party, neither use for my own benefit or that of a third party, nor make public, either verbally or in writing, in paper or electronic format, documents or information that are not public knowledge and to which I had or may have access as part of the collaboration between (… … … …. … [company name]) and the European Commission. This ban shall continue to apply following termination of the contract.
I undertake to refrain from statements that could endanger the reputation of the European Commission and its profile or harm the security of its buildings.
I undertake to respect the confidentiality of all confidential documents to which I, my staff, our contractors and subcontractors may have access and that we may handle. In this context, I will act only in consultation with the Head of Unit responsible for the 'Health and safety at work policy' or his qualified representative within the European Commission's Directorate-General for Human Resources and Security.
I also undertake, once collaboration with the European Commission has come to an end, to give back to the designated officials, all documents that may still be in my possession, irrespective of their form (paper or electronic).
Should these provisions not be respected, the European Commission reserves the right to demand that the person who has not honoured his commitment to confidentiality no longer has access to this information, without bearing any consequences therefor.

III.2.2)Economic and financial ability
Information and formalities necessary for evaluating if the requirements are met: the candidate must provide:
— copy of the financial statements (balance sheets and operating accounts) for the past 3 financial years, showing the annual pre-tax profit. If, for a valid reason, the candidate is unable to provide them, he must enclose a statement as to annual pre-tax profits for the past 3 years. If the financial statements or the declaration show an average loss over the past 3 years, the candidate must provide another document as proof of his financial and economic capacity, such as an appropriate guarantee from a third party (e.g. the parent company), statements from auditors, chartered accountants or equivalent.
— statement as to overall annual turnover during the past 3 financial years.
Minimum level(s) of standards possibly required: the overall average annual turnover for the past 3 years must be at least 6 000 000 EUR.
III.2.3)Technical capacity
Information and formalities necessary for evaluating if the requirements are met:
the candidate must provide:
— list of the 5 main structural works carried out over the past 3 years, with details of the year of performance, surface area, value, duration and particulars of the recipients of the works carried out, parts subcontracted with the names and particulars of the subcontractors. The Commission reserves the right to ask the recipients of the stated works how satisfied they were with the services provided by the candidate,
— statement as to whether or not the candidate intends subcontracting part of the contract and, if so, the proportion likely to be subcontracted. Any part of the contract which is subcontracted remains the candidate's responsibility,
— statement as to the candidate's average annual manpower per category of staff (management, workers) for the field of activity covered by the contract, during the past 3 years,
— CV of a project coordinator (engineer or architect) with 10 years' professional experience (years of experience are calculated after obtaining the basic qualifications) in the field of activity covered by this contract — structural works. The training received and the duties performed by this person must be stated in the CV, which must also include a copy of the engineering degree,
— CV of a technical manager (engineer or architect) with 10 years' professional experience in the field of special techniques (years of experience are calculated after obtaining the basic qualifications). The training received and the duties performed by this person must be stated in the CV, which must also include a copy of the engineering degree,
— CV of an engineer with with 10 years' professional experience in the field of stability (years of experience are calculated after obtaining the basic qualifications). The training received and the duties performed by this person must be stated in the CV, which must also include a copy of the engineering degree,
— an ISO 9001 certificate or equivalent, or a dossier demonstrating that an internal quality control system has been set up corresponding to the aforementioned standard,
— ISO 14001 or EMAS certificate or equivalent, or a dossier demonstrating that an internal environmental management system has been set up in the field of this procedure and meets the following requirements:
• minimisation of on-site waste production, appropriate waste treatment methods, recycling of materials, prevention of the dumping of hazardous waste and dangerous substances which may have a negative environmental impact,
• comprehensive approach for managing projects aiming to minimise the negative environmental impact.

1) The attention of interested parties is drawn to the aim of this notice, i.e. to select candidates who will receive the specifications and be invited to tender.
