List and brief description of conditions:

Cerinta nr. 1: Neincadrarea in situatiile prevazute la art. 164, 165 si 167 din Legea 98/2016 privind achizitiile publice.Ofertantii/ membrii asocierii/ subcontractantii/tertii sustinatori nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165 si 167 din Legea 98/2016 privind achizitiile publice. Incadrarea in situatiile prevazute la art. 164, 165 si 167 din Legea 98/2016 atrage excluderea oricarui operator economic din procedura aplicata pentru atribuirea contractului de achizitie publica.

Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documentele justificative, care probeaza indeplinirea celor asumate prin completarea DUAE la momentul prezentarii (cum ar fi certificate care atesta lipsa datoriilor cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat, etc., trebuie sa ateste lipsa datoriilor restante la momentul prezentarii acestora, cazier judiciar al operatorului economic, cazier judiciar pentru orice persoana care este membru al organismului de administrare, de conducere sau de supraveghere al respectivului operator economic, sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv In acelasi timp, prin aceste documente, operatorul economic poate demonstra ca poate sa beneficieze de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice.

Acestea urmeaza a fi prezentate la solicitarea autoritatii contractante doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Cerinta nr. 2: Declaratie privind neincadrarea in prevederile art.59 (evitarea conflictului de interese) coroborat cu art.60 din Legea nr.98/2016 .Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Incadrarea in situatia prevazuta la art. 59 din Legea nr. 98/2016 privind achizitiile publice atrage excluderea ofertantului din procedura aplicata pentru atribuirea contractului de achizitie publica.

Cerinta nr. 1 – Operatorii economici ce depun oferta trebuie sa dovedeasca o forma de inregistrare in conditiile legii din tara de rezidenta, din care sa reiasa ca operatorul economic este legal constituit, ca nu se afla in niciuna dintre situatiile de anulare a constituirii precum si faptul ca are capacitatea profesionala de a realiza activitatile care fac obiectul contractului.Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Documente probatorii, pe care operatorii economici sunt obligati sa le prezinte doar la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor: certificat constatator emis de ONRC, sau in cazul ofertantilor straini, documente echivalente emise in tara de rezidenta. Informatiile cuprinse in certificatul constatator trebuie sa fie reale/actuale la momentul prezentarii. In cazul ofertantilor de alta nationalitate decat cea romana, documentele vor fi insotite de o traducere a acestora in limba romana. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE urmeaza sa fie prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

Cerinta nr. 2 - Aviz de functionare emis de Ministerul Sanatatii Publice in conformitate cu Legea 95/2006 si OUG nr. 2/2014 pentru modificarea si completarea Legii 95/2006 privind reforma in domeniul sanatatii, art. 888Se va completa DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor.

Documente probatorii, pe care operatorii economici sunt obligati sa le prezinte doar la solicitarea autoritatii contractante la finalizarea evaluarii ofertelor: Aviz de functionare emis de Ministerul Sanatatii Publice in conformitate cu Legea 95/2006 si OUG nr. 2/2014 pentru modificarea si completarea Legii 95/2006 privind reforma in domeniul sanatatii, art. 888.
