Gegadigden die niet in aanmerking komen voor deelname aan de gunningsfase ontvangen een motivatie van de redenen tot afwijzing. De aanbestedende dienst hanteert een periode van tien dagen vanaf het bekendmaken van de selectiebesluit aan de gegadigden totdat overgegaan wordt naar de gunningsfase. Als binnen die termijn een kort geding tegen de selectiebeslissing aanhangig is gemaakt, wordt in eerste beginsel de start van de gunningsfase, in afwachting van de uitspraak van de rechter, opgeschort. Indien de gegadigde niet binnen deze termijn een kort geding aanhan-gig maakt, dan wordt geacht dat de gegadigde afstand heeft gedaan van dit recht en is de gegadig-de niet-ontvankelijk in zijn vorderingen, wanneer de gegadigde alsnog een kort geding aanhangig maakt.
