Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

a) Umstände, die AG im Rahmen seiner Sorgfaltspflicht nicht vorhersehen konnte Die Nachtragsleistung war bei der Ausschreibung der Hauptleistung nicht erkennbar. Im Hauptvertrag sind für die Objekt- und Tragwerksplanung Ingenieurbauwerke vorläufige Berechnungshonorare gemäß HOAI und der in Anlage 2.1 zum Hauptvertrag vereinbarten Objektstruktur vereinbart. Im Ergebnis des mit einer Prüffassung zum 31.7.2020 erreichten Stands der RE-Entwurfsplanung ist eine wesentliche Erhöhung der Baukosten und damit der anrechenbaren Kosten gegenüber dem Kostenstand zum Vertragsabschluss zu verzeichnen.

b) Gesamtcharakter des Auftrags bleibt unverändert Im Zuge der Entwurfsplanung wurde eine detaillierte Kostenberechnung durchgeführt, die eine wesentliche Erhöhung der Baukosten und damit der anrechenbaren Kosten gegenüber dem Kostenstand zum Vertragsabschluss zu verzeichnen.
