III.1)Conditions for participation
III.1.1)Suitability to pursue the professional activity, including requirements relating to enrolment on professional or trade registers

Informatii si formalitati necesare pentru evaluarea respectarii cerintelor mentionate

C.I. Ofertantii, tertii sustinatori si subcontractantii nu trebuie sa se regaseasca in situatiile prevazute la art. 164, 165 si 167 din Legea nr. 98/2016.

Modalitatea prin care poate fi demonstrata initial indeplinirea cerintei: se va completa Documentul Unic de Achizitie European (DUAE) conf. art. 193 din Legea nr. 98/2016, de catre operatorii economici participanti la procedura de atribuire, cu informatiile aferente situatiei lor. Aceste documente pot fi:

1) certificate constatatoare privind lipsa datoriilor restante cu privire la plata impozitelor, taxelor sau a contributiilor la bugetul general consolidat (buget local, buget de stat etc.). Certf. de atestare fiscala pt bugetul local de la sediul principal valabil la momentul prezentarii;

2) cazierul judiciar al operatorului economic si al membrilor organului de administrare, de conducere sau de supraveghere al respectivului operator economic sau a celor ce au putere de reprezentare, de decizie sau de control in cadrul acestuia, asa cum rezulta din certificatul constatator emis de ONRC/actul constitutiv;

3) dupa caz, documente prin care se demonstreaza faptul ca, operatorul economic poate beneficia de derogarile prevazute la art. 166 alin. (2), art. 167 alin. (2), art. 171 din Legea 98/2016 privind achizitiile publice;

4) alte documente edificatoare, dupa caz.

In cazul operatorilor economici straini se vor prezenta documente echivalente emise in conformitate cu legislatia aplicabila in tara de rezidenta. Documentele justificative care probeaza indeplinirea celor asumate prin completarea DUAE, respectiv documente echivalente emise in tara de rezidenta pentru ofertantii straini, urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 5 locuri stabiliti in urma evaluarii ofertelor financiare.

C.II. Declaratie privind neîncadrarea în prevederile art. 60 din Legea 98/2016, prezentata atat de ofertant cat si de subcontractant si tertul sustinator, daca este cazul. Persoanele cu functie de decizie în cadrul autoritatii contractante, sunt:

DUAE este disponibil prin intermediul serviciului online dedicat, pus la dispozitie gratuit de Comisia Europeana disponibil la adresa https://ec.europa.eu/growth/toolsdatabases/espd/filter

Toate documentele, respectiv DUAE, Declaratia privind neîncadrarea în prevederile art. 60 din Legea 98/2016, documentele propunerii tehnice, propunerii financiare si documentul care atesta constituirea garantiei de participare, se vor depune in SICAP, semnate cu semnatura electronica.

Documentele prezentate de persoanele fizice/straine sunt acceptate cu conditia sa fie in conformitate cu prevederile legale din tara in care ofertantul este rezident si sa fie prezentate in copie si in traducere in limba romana, semnate si parafate de un traducator autorizat. List and brief description of selection criteria:

Loturile: 1, 10, 11, 12, 13, 14, 2, 3, 4, 5, 6, 7, 8, 9. Pentru contractele de achizitie de bunuri: executarea de livrari de tipul specificat. Se va completa in DUAE o lista a produselor similare furnizate in cel mult ultimii 3 ani calculați retroactiv de la data limită a depunerii ofertelor conf. prevederii art. 179 lit. b) din Legea 98/2016.

Minimum level(s) of standards possibly required:

Pentru contractele de achiziție de produse: executarea de livrări de tipul specificat (Legea nr. 98/2016 privind achizitiile publice art. 178, art. 179 lit. b). Confirmarea livrarii produselor consta in prezentarea unuia/unor certificat/document/contract/proces-verbal de receptie emis sau contrasemnat de o autoritate ori de catre clientul beneficiar. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE pot fi unul sau mai multe la solic. A.C. din urmatoarele: certificat/document/contract/proces-verbal de receptie emis sau contrasemnat de o autoritate ori de catre clientul beneficiar. Completarea in DUAE de catre operatorii economici participanti la procedura de atribuire cu informatiile aferente situatiei lor. Completarea DUAE. Documentele vor fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 5 locuri stabiliti in urma evaluarii ofertelor financiare. Documentele solicitate vor fi transmise prin intermediul SICAP, semnate cu semnatura electronica extinsa.

Acordul-cadru se va incheia cu maxim 5 operatori economici care depun oferte admisibile. In cazul in care 2 sau mai multe oferte sunt situate pe primul loc, autoritatea contractanta solicita ofertantilor o noua propunere financiara, iar contractul va fi atribuit ofertantului a carui noua propunere financiara are pretul cel mai scazut, conform art. 138 alin. (1), (2) din HG 395/2016. Atunci cand 2 sau mai multe oferte au o valoare totala egala a propunerii financiare si sunt clasate pe acelasi loc, in vederea departajarii, autoritatea contractanta solicita noi propuneri financiare acestora, oferta fara ca acest lucru sa afecteze pozitiile superioare in clasament, conform art. 138 alin. (3) din HG 395/2016. Sau In situatia incheierii unui acord-cadru cu mai multi operatori economici,cu reluarea competitiei, atunci cand 2 sau mai multe oferte au aceeasi valoare totala a propunerii financiare si sunt clasate pe acelasi loc, A.C. mentioneaza in documentatia de atribuire daca uzeaza de prevederile alin. (3) sau daca va incheia acordul-cadru cu toti operatorii economici clasati pe locurile aferente numarul maxim stabilit in anuntul de participare conform art. 138 alin. (4), din HG 395/2016. Solicitari de clarificari/raspunsurile la solicitarile de clarificari se vor transmite numai prin intermediul SICAP.
