The Cabinet Office, acting as the Contracting Authority, publishes this Contract Notice in regard to the requirement to let a three (3) year Framework Agreement (with the option of a one (1) year extension) for use by the Government Digital Service (GDS) for the provision of Identity Assurance Services (through GOV.UK Verify).
This procurement competition is managed on behalf of the Contracting Authority by the Crown Commercial Service (CCS).
GDS manages GOV.UK Verify for central government. GOV.UK Verify is a new way for people to prove their identity when accessing digital services. It allows those services to be confident that users are who they say they are to a defined Level of Assurance (LoA).
The Government's aim is that all the central government services that need identity assurance for individuals will be using GOV.UK Verify by March 2016.
The aspiration is for central government, together with the Providers under this Framework Agreement and others, to work together to develop, broaden and stimulate the market for identity assurance services. This aspiration is initially focused on the wider public sector, with potential expansion into the private sector and other countries to follow.
It is envisaged this Framework Agreement will be entered into by up to ten (10) Providers. Each of the Providers will have to satisfy a number of conditions precedent and pass through a number of process acceptance gates before going live on the system.
The potential value of the Framework Agreement is estimated to be 150 000 000 GBP over a three (3) year duration. This figure is that which is likely to be necessary to meet the requirements of central government. However, there may be additional demand from relying parties in the wider public sector - such as health and local authority services — during the lifetime of the Framework Agreement (see section VI.3 below for more information).
The right is reserved to award multiple and/or successive and/or overlapping Call-off Contracts during the lifetime of the Framework Agreement.
The initial Call-Off Contract, which will be awarded at the same time as the Framework Agreement is signed, will be for Level of Assurance 2 (LoA2) only. GDS expects to procure Additional Services as set out in the Framework Agreement. Additional services may include Level of Assurance 1 (LoA1) and Level of Assurance 3 (LoA3).
All Framework Agreement Providers will be expected to sign the first Call-Off Contract and must be ready to enter into the first Call-Off Contract as soon as they have satisfied the Operational Conditions Precedent in the Framework Agreement. They must also adhere to the price as agreed in the Framework Agreement.
The contractual terms of the Framework Agreement are non-negotiable.
No organisation will be permitted to act as a material subcontractor to more than three (3) Potential Providers in total (including themselves if they are a Potential Provider). The purpose of this restriction is to protect the resilience and diversity of GOV.UK Verify.
The Contracting Authority expects to award the Framework Agreement by April 2015.
The eventual value of the Framework Agreement may be larger or smaller than the indicated amount and will depend on the extent of demand from and take-up of government services, the ability of Providers to meet that demand and the prices bid by the successful Providers.
The Contracting Authority reserves the right to hold an electronic auction during further competitions (at Call-Off only) among the parties to the Framework Agreement. This is at the discretion of the Authority.

Background information
GOV.UK Verify establishes a federated approach to identity; individuals select a third-party Identity Provider to verify their identity. Identity Providers check a range of evidence against published standards to establish to a defined level of confidence that the user is who they say they are. The Identity Provider then assures the identity to the GDS hub, which then confirms that assurance to the relevant government service. The service is built to protect users' privacy and security. It works within the parameters of identity assurance principles set by an independent advisory group.
Each assured identity is valid across all digital services that use GOV.UK Verify as a means for people to access the service. This procurement is for the provision of identity assurance services, namely identity proofing and authentication for people accessing government services via the Identity Assurance hub, in compliance with the relevant standards.

III.2.2)Economic and financial ability
Information and formalities necessary for evaluating if the requirements are met: Potential Providers will be assessed in accordance with Part 4 of the Public Contracts Regulations 2006, as amended (implementing Title II, Chapter V11, Section 2 of Directive 2004/18/EC) on the basis of information provided in response to an ITT.

The ITT can be accessed at using the instructions detailed in III.2.1.

The Contracting Authority may take into account any of the following information:
(a) appropriate statements from banks or, where appropriate, evidence of relevant professional risk indemnity insurance;
(b) the presentation of balance sheets or extracts from the balance sheets, where publication of the balance sheet is required under the law of the country in which the economic operator is established;
(c) a statement of the undertaking's overall turnover and, where appropriate, of turnover in the area covered by the contract for a maximum of the last three (3) financial years available, depending on the date on which the undertaking was set up or the economic operator started trading, as far as the information on these turnovers is available.

Potential Providers will be assessed in accordance with Part 4 of the Public Contracts Regulations 2006, as amended (implementing Title II, Chapter V11, Section 2 of Directive 2004/18/EC) on the basis of information provided in response to an ITT.

The ITT can be accessed at using the instructions detailed in III.2.1.

The Contracting Authority may have regard to any of the following means in its assessment:
(a) a list of the works carried out over the past five (5) years, accompanied by certificates of satisfactory execution for the most important works. These certificates shall indicate the value, date and site of the works and shall specify whether they were carried out according to the rules of the trade and properly completed. Where appropriate, the competent authority shall submit these certificates to the contracting authority direct;
(b) a list of the principal deliveries effected or the main services provided in the past three (3) years, with the sums, dates and recipients, whether public or private, involved. Evidence of delivery and services provided shall be given:
— where the recipient was a contracting authority, in the form of certificates issued or countersigned by the competent authority,
— where the recipient was a private purchaser, by the purchaser's certification or, failing this, simply by a declaration by the economic operator;
(c) an indication of the technicians or technical bodies involved, whether or not belonging directly to the economic operator's undertaking, especially those responsible for quality control and, in the case of public works contracts, those upon whom the contractor can call in order to carry out the work;
(d) a description of the technical facilities and measures used by the Potential Provider or service Provider for ensuring quality and the undertaking's study and research facilities;
(e) where the products or services to be supplied are complex or, exceptionally, are required for a special purpose, a check carried out by the contracting authorities or on their behalf by a competent official body of the country in which the Potential Provider or service provider is established, subject to that body's agreement, on the production capacities of the Potential Provider or the technical capacity of the service provider and, if necessary, on the means of study and research which are available to it and the quality control measures it will operate;
(f) the educational and professional qualifications of the service provider or contractor and/or those of the undertaking's managerial staff and, in particular, those of the person or persons responsible for providing the services or managing the work;
(g) for public works contracts and public services contracts, and only in appropriate cases, an indication of the environmental management measures that the economic operator will be able to apply when performing the contract;
(h) a statement of the average annual manpower of the service provider or contractor and the number of managerial staff for the last three years;
(i) a statement of the tools, plant or technical equipment available to the service provider or contractor for carrying out the contract;
(j) an indication of the proportion of the contract which the services provider intends possibly to subcontract;
(k) with regard to the products to be supplied: (i) samples, descriptions and/or photographs, the authenticity of which must be certified if the contracting authority so requests; (ii) certificates drawn up by official quality control institutes or agencies of recognised competence attesting the conformity of products clearly identified by references to specifications or standards.

Potential Providers should note that, in accordance with the UK Government's policies on transparency, the Contracting Authority intends to publish the ITT document and the text of any Framework Agreement awarded, subject to possible redactions at the discretion of the Contracting Authority. The terms of the proposed Framework Agreement will also permit a public sector contracting authority that is awarding a contract under this Framework Agreement to publish the text of that contract, subject to possible redactions at the discretion of the contracting authority. The Contracting Authority expressly reserves the right
(i) not to award any contract as a result of the procurement process commenced by publication of this notice; and
(ii) to make whatever changes it may see fit to the content and structure of the tendering competition.
In no circumstances will the Contracting Authority be liable for any costs incurred by the Potential Providers. If the Contracting Authority decides to enter into a Framework Agreement with the successful Provider, save as mentioned above in respect of the first Call-Off Contracts, this does not mean that there is any guarantee of subsequent Contracts being awarded. Any expenditure, work or effort undertaken prior to contract award is accordingly a matter solely for the commercial judgement of Potential Providers. Any orders placed under this Framework Agreement will form a separate contract under the scope of this Framework between the Potential Provider and the Contracting Authority.
