Market for the realisation of the main civil engineering of a pair of EPR2 type power generation units in France
Completion of the main civil engineering of the works and buildings on site, the purpose of which is, in particular, to:
— earthworks (excavations, backfill) and demolition of existing structures,
— the construction of reinforced concrete structures, in special concrete concrete, prestressed concrete,
— the construction of all technical installations,
— erection of metal and cladding frames,
— Manufacture of metallic coatings in black and stainless steel,
— the study, manufacture and installation of ordinary and fire doors,
— the carrying out of studies on metal structures (calculation notes and plans),
— studies of excavations, roof supports and backfill,
— the study and construction of the ‘operational hub’ building,
On the basis of the following data and specifications provided by EDF:
— digital plans or layouts,
— technical specifications of the operational centre building.
The pair of power generating modules of type EPR2 will be located on one of the nuclear sites in operation in France.
Brief description of the works:
The contract consists of the construction of the main buildings of 2 units EPR2 on the same site.
For each tranche, the same buildings are to be built, divided into several blocks: nuclear island (NI: steam production), conventional island (CI: electricity generation and energy disposal) and Balance of Plant (BOP: cold source, technical galleries, site buildings).
Some buildings are common to all 2 tranches, including: the nuclear island effluent treatment building and the operational centre of operation (offices and workshops).
Certain works necessary for the operation or operation of the 2 instalments do not form part of the market: tunnels for the discharge of cooling water in the sea (in the case of a sea edge site), and certain tertiary or service buildings, which are furthest away from the factory block.
The total volume of concrete of the buildings included in the contract is in the order of 800 000 m.32.
State body included in the contract.
The market comprises the following main State bodies:
— site installations,
— excavations and backfills,
— reinforced and pretensioned concrete (the reactor building containment chamber is prestressing),
— metal frame and cladding of the engine room,
Metallic steel covering of the confinement facility of the containment body,
— stainless steel cladding of the reactor building’s swimming pools and the fuel building,
— ordinary and fire doors,
— handling of miscellaneous equipment, including consignments imprisoned for third parties: these are equipment, not including the supply of the market, which need to be set aside (for example: interchanges, pumps, etc.). This equipment is in prison because they will be introduced before civil engineering ends, as they are too large to pass through the final doors/openings,
— different inserts in the concrete of the structures (anchor plates, sleeves, etc.),
— certain temporary or definitive GERD.
Studies, manufacture and installation of electromechanical equipment (except in exceptional cases such as elevators) are excluded from the market.
They are, for the most part, supplied to the contractor by EDF; they shall take account of the methods of implementation previously supplied by the Contractor,
— the performance studies remaining at the Contractor’s expense are the studies for earthworks and roof supports, the studies of the metal frame and the cladding of the engine room.
Building in design.
The building called the operational centre of operation will be carried out by the holder in design of all the State Corps, on the basis of a set of specifications provided by EDF.

All the selection criteria are available on the electronic purchasing platform of EDF through the request for information n.o RFx_076323.
These criteria include:
— 10 of them are eliminatory in nature, one of which is assessed if the criterion is fulfilled;
— 20 are reportees.
EDF will retain the 4 highest-scoring candidates.
If the minimum number of 3 candidates is not reached, EDF reserves the right not to continue with the purchase procedure.
If the existence of technical options is confirmed, they will, where appropriate, be presented in the consultation documents.
Section III: Legal, economic, financial and technical information
— the applicant must provide a declaration on his/her honour to justify that he/she does not enter into any of the cases referred to in Articles L. 2141-1 to L. 2141-5 and L. 2141-7 to L. 2141-11 of the Code de la commande public, in particular that he fulfils the obligations concerning the employment of disabled workers defined in Articles L. 5212-1 to L. 5212-11 of the Labour Code. This declaration must be produced by the individual candidates, by each member of a candidate group and, where appropriate, by the subcontractors submitted,
— the applicant must submit an extract from the relevant and up to date register, such as a K-Bis extract, or, failing that, an equivalent document enabling the candidate to be identified. This document is to be provided by the individual candidates and by each member of an applicant group.
— the applicant must provide the financial statements (balance sheets and profit and loss accounts) for the last 3 financial years available, attesting to its financial sustainability.
— if, in view of the date on which the applicant was set up, the candidate does not have all the information, to submit equivalent documents.
For an individual tenderer or for a GME: the average annual turnover of EUR 1 000 000 000 over the last 2 years in the construction sector (construction and public works).
In the case of GME, the joint and several trustee will have to justify a turnover of EUR 800 000 000 in the construction sector (construction and public works).
For each of the following minimum technical and professional experience, the candidate must provide evidence from 3 contracts contracted in Europe over the last 10 years, one of these contracts having been contracted in the past 5 years. At least one of these contracts must relate to the execution of works to be operated in accordance with the BNI legislation (or equivalent in Europe); the same markets can be referenced for several experiments. In the case of contracts entrusted to a group of undertakings, the proportion of the contract awarded to the applicant in the group must have been preponderant (percentage to be communicated by the applicant). A contract in progress may be considered provided that the services to which the criterion relates have been performed on a date.
— the applicant must have a system of management of health and safety at work in accordance with the MASE framework, or the candidate must have an equivalent reference system, or the candidate must be required to undertake to acquire it before the contract is signed. The applicant must provide the certificate of MALSE qualification or equivalent, or the undertaking to obtain it before the contract is signed;
— the applicant must provide a declaration of honour by undertaking to train on-site personnel in the field of security,
The empowerment is the formal recognition of professional competence in Quality Assurance (QA) of a person enabling him/her to exercise a given level of responsibility in a defined technical field.
In the context of this contract, the operators who are called upon to work on the temporary or final electrical works in the very low voltage and high voltage fields must be authorised (minimum B0/H0); the candidate undertakes to obtain these authorisations: to provide a commitment on the part of the applicant,
— the applicant must have a management system for environmental protection in accordance with European standard NF EN ISO 14001, or the candidate must have an equivalent reference system, or a candidate must undertake to purchase it before the contract is signed. The applicant must provide the certificate of qualification ISO 14001 or equivalent, or the undertaking to obtain it before the contract is signed;
— the applicant has a quality assurance system in accordance with European standard NF EN ISO 9001 ‘Quality system — model for quality assurance in design, development, production, installation and support after the sale’, or the applicant has an equivalent benchmark or undertakes to acquire it before the contract is signed. The applicant provides certificate of qualification ISO 9001 or equivalent, or an undertaking to obtain it before the contract is signed;
— the applicant must provide a declaration on their honour to undertake to make every effort to ensure that its staff working on site are able to understand and comply with the safety requirements, as well as the alarm signals, expressed in French. Management staff must be fluent in written and spoken French.
A bank guarantee may be required before the contract is signed.
Own resources funding.
Payment at 60 days from the date of issue of the invoice and payment of payments on account corresponding to the services performed.
EDF accepts groupings of joint or several undertakings. In the case of a group, one of the members of the group shall be appointed as the authorised representative. That group is jointly and severally liable for the performance of the contract from each of the members of the group in respect of its contractual obligations towards EDF.
Without prejudice to Article L. 2141-13 of the Public Order Code, the composition of the grouping may not be altered between the date of submission of applications and the date on which the contract is signed, except in the event of a company restructuring or if the group provides evidence that one of its members is unable to carry out its task for reasons which are not its own.
In addition, a tenderer, who will propose a tender for a consortium, will not be able to submit bids either individually or under another grouping.
In order to carry out the services described in paragraph II.2.4), the successful tenderer must have been qualified by EDF under the current framework, in particular the SGAQ (General Specification for Quality Assurance) D309518038669 relating to the new construction in France of basic nuclear installations of type EPR 2.
In the case of a grouping, each member of the grouping must be qualified in the field and in the field in which it is required if the description is required. Subcontractors must be qualified if it is not for the activity in question to whom the contract is awarded.

— the interested firm wishing to apply for an application and is not registered for EDF’s purchases, must register;

In the context of the dematerialisation of its procedures, EDF SA informs all tenderers that the electronic signature of contracts is preferred, whether they are awarded to a single undertaking or to a group of undertakings,
— in the context of this contract, the contracting entity has intended to compensate, on an exceptional basis, suppliers for the preparation of their tenders. The contracting entity shall award exceptional flat-rate compensation to unsuccessful tenderers which have submitted a technical tender which is deemed admissible on the basis of the elements forming part of the consultation file. The conditions for obtaining such compensation will be set out in detail in the consultation file.
The consultation falls within the framework of DE2014/25/EU with a competitive dialogue procedure within the meaning of the Order no 2015-899 of 23.7.2015, and not within the meaning of the Public Procurement Code.
