Contract specifications

6.Description of the contract:
The contract will include the following works:
The WWTP is to be constructed in 2 stages. The contractor will carry out the works for stage I only. Stage I is designed to meet the projected 2030 demand and it is planned that the WWTP will be extended in the future in order to meet the projected 2045 demand (stage II). The process design capacities of both stages are summarised below:

— WWTP capacity — stage I: average flow rate 111 023 m3/day

— WWTP capacity — stage II: average flow rate 154 443 m3/day

The works contractor shall carry out all civil, building, mechanical, electrical, instrumentation, control and automation works necessary for the complete construction of the WWTP as defined within the tender dossier.
In addition, the contractor shall operate the WWTP during the trial operational period prior to takeover by the employer. The contractor shall train the end-recipient's operational staff (maximum 10) before takeover. Timing and total duration of the training shall be organised in accordance with the requirements given in the employer's requirements.
Please note that signature of this contract is subject to the signature of the technical assistance and supervision service contract for the construction of Kahramanmaraş waste water treatment plant.
In case of cancellation, termination or suspension of the related technical assistance and supervision service tender or any obstacles/delays in obtaining required permits, the contracting authority has the right to cancel the procedure, suspend or modify the contract as appropriate.
The contract will be implemented as per FIDIC (Yellow Book) conditions of contract.

Terms of participation

8.Eligibility and rules of origin:
Participation is open to all legal persons (participating either individually or in a grouping (consortium) of tenderers) which are established in a Member State of the European Union or in a country or territory of the regions covered and/or authorised by the specific instruments applicable to the programme under which the contract is financed (see item 22 below). All goods supplied under this contract must originate in 1 or more of these countries. Participation is also open to international organisations. Participation of natural persons is directly governed by the specific instruments applicable to the programme under which the contract is financed.
9.Grounds for exclusion:
Tenderers must submit a signed declaration, included in the tender form for a works contract, to the effect that they are not in any of the situations listed in point 2.3.3 of the 'Practical Guide'.
10.Number of tenders:
Tenderers may submit only 1 tender per lot. Tenders for parts of a lot will not be considered. Any tenderer may state in its tender that it would offer a discount in the event that its tender is accepted for more than 1 lot. Tenderers may not submit a tender for a variant solution in addition to their tender for the works required in the tender dossier.
11.Tender guarantee:
Tenderers must provide a tender guarantee of 500 000 EUR when submitting their tender. This guarantee will be released to unsuccessful tenderers once the tender procedure has been completed and to the successful tenderer(s) upon signature of the contract by all parties. Tenderers with tender guarantees which are shorter in duration or lower in required amount will be rejected.
12.Performance security:
The successful tenderer will be asked to provide a performance security of 10 % of the amount of the contract at the signing of the contract. This security must be provided together with the return of the countersigned contract no later than 30 days after the tenderer receives the contract signed by the contracting authority. If the selected tenderer fails to provide such a security within this period, the contract will be void and a new contract may be drawn up and sent to the tenderer which has submitted the next cheapest compliant tender.
13.Information meeting and/or site visit:
A mandatory information meeting and/or site visit will be held on 6.3.2015 (10:00) at Kahramanmaraş greater municipality and on the project site. Tenderers shall meet at Kahramanmaraş municipality, Kahramanmaraş/Turkey at the indicated date and time.
14.Tender validity:
Tenders must remain valid for a period of 90 days after the deadline for submission of tenders.
15.Period of implementation of tasks:
Time for completion of the works: 730 days from the commencement date and 365 days of defects notification period from the date of takeover including technical training and supervision of operation.


Selection and award criteria

16.Selection criteria:
1) General:
the tenderer must be a registered firm or natural person capable of carrying out the specified works.
2) Economic and financial capacity of the candidate:
a) annual turnover: (the amount of business done in a year, incomes generated from ongoing works and incomes generated from works undertaken shall be considered as part of the turnover). The joint venture/consortium as a whole must satisfy the minimum qualifications required below:
the average annual turnover of the tenderer in the past 3 financial years must be a minimum of 10 000 000 EUR or equivalent.
This must be proven by the financial statements of the company (including balance sheet, profit and loss account, cash flow statement and statement of changes in equity) over the last 3 financial years, audited by a certified public (sworn)/chartered accountant and as required by the law of the country in which the tenderer is established;
b) financial resources:
the tenderer shall demonstrate, by a bank statement from his bank, that he has available or has access to liquid assets, lines of credit, or other financial means sufficient to meet the construction cash flow for the contract of not less than 5 000 000 EUR or equivalent in addition to the tenderer's commitments for other contracts. The evidence shall clearly demonstrate that the financing is available for the concerned contract;
c) financial position:
the audited financial statements (audited balance sheets and income tables or, if not required by the law of the tenderer's country, other financial statements acceptable to the contracting authority) as well as the report of a certified public (sworn) accountant for the past 3 financial years shall be submitted and must demonstrate the soundness of the applicant's financial position, showing long-term profitability.
The tenderer should be in positive profit account for at least 2 of the past 3 financial years.
The contracting authority reserves the right to carry out any such further inquiry on the tenderer's financial standing as the Evaluation Committee may deem appropriate.

For the purposes of converting another currency into euro, the conversion rates, published in the Official Journal of the European Union shall be used, which can be found at: http://ec.europa.eu/budget/inforeuro/index.cfm?Language=en

For calculating annual turnovers in euro, the rates for June of each year shall be used.
3) Technical and professional capacity of candidate:
Work experience:
The tenderer must have completed similar contracts as defined below within the past 5 years up to the submission deadline of this tender, i.e. 60 months prior to the deadline for submission of tenders (final/performance or provisional acceptance/taking over certificates should clearly indicate the official completion dates and that the works have been completed in the past 5 years):
i. the tenderer shall have experience in the construction of at least 1 drinking water project and/or waste water/stormwater project with a minimum value of 28 000 000 EUR or at least 2 drinking water projects and/or waste water/stormwater projects with a minimum value of 21 000 000 EUR each (the total value of works the contractor was responsible for). Rehabilitation and/or extension works shall not be accepted as similar works;

ii. regardless of budget, the tenderers shall have completed at least 1 WWTP with nitrogen and phosphorus removal and with a minimum capacity of 65 000 m3/day average waste water flow rate. For rehabilitation and extension works, the tenderer should demonstrate that the capacity increase by the extension is at least 65 000 m3/day average waste water flow rate;

iii. the tenderer or its nominated subcontractor must have successfully completed, as prime designer, the process design of at least 1 waste water treatment plant with nitrogen and phosphorus removal and anaerobic digestion project design with a minimum of 65 000 m3/day average waste water flow rate. For rehabilitation and extension works, the tenderer should demonstrate that the capacity increase by the extension is at least 65 000 m3/day average waste water flow rate.

Previous experience of the tenderer must be proven by an original or notary-approved copy of taking over (provisional acceptance) or performance (final acceptance) certificates, signed by the supervisors (the engineer)/contracting authority of the projects concerned. Ongoing works of the tenderer will not be taken into consideration.
If all of the works specified above have been performed within the scope of a single contract, it must satisfy each criterion separately.
If a tenderer has implemented the project in a JV/consortium, it should be clear from the documentary evidence (taking-over/performance certificates) the percentage the tenderer has completed. Should the submitted documents not provide clear information on the percentage of the works, it will be clarified by further documents.
The contracting authority reserves the right to ask for originals of the respective certificates of provisional or final acceptance signed by the project managers/contracting authority of the concerned projects.
Regarding the calculation of the contract amounts for the completed works of the tenderers, the euro equivalent of the contract amounts at the date of contract signature will be considered and will not be carried to the date of the evaluation as 'net present values'.

The contracting authority reserves the right to carry out any further inquiry on the tenderer's document as the Evaluation Committee may deem appropriate.
4) A joint venture/consortium shall meet the following particular qualification criteria:
i) the leading member shall meet not less than 50 % of the turnover criteria and financial resources criteria specified above;
ii) each member shall meet not less than 25 % of the turnover criteria and financial resources criteria specified above;
iii) each individual member must be a registered firm or natural person legally capable of carrying out the specified works. The joint venture/consortium as a whole must be in positive profit account at least 2 of the last 3 financial years;
iv) the joint venture/consortium must collectively satisfy the turnover and financial resources and the works experience criteria stated under 16.2(a), 16.2(b), 16.2(c) and respectively 16.3.
An economic operator may, where appropriate and for a particular contract, rely on the capacity of other entities, regardless of the legal nature of the links which it has with them. Some examples of when it may not be considered appropriate by the contracting authority are when the tenderers rely mostly on the capacities of other entities or when they rely on key criteria. If the tenderer relies on other entities, it must prove to the contracting authority that it will have at its disposal the resources necessary to perform the contract, for example by producing an undertaking on the part of those entities to place resources at its disposal. Such entities, for instance the parent company of the economic operator, must respect the same rules of eligibility and notably that of nationality, as the economic operator. Furthermore, the tender should include a separate document providing data on this third entity for the relevant selection criterion. Proof of capacity must be furnished at the request of the contracting authority.

Drawings and documents, including geotechnical report, are available at the premises of the contracting authority at the above address in a CD-ROM free of charge.
The CD can be collected by those tenderers who declare their interest in written form to the Department of EU Investments.
As an alternative, tenderers can make all necessary arrangements with a courier service company to collect the CD directly from the contracting authority's premises, at the cost of the tenderers.
The contracting authority will neither organise the shipment nor pay for the couriers' fees.
Tenders must be submitted using the standard tender form included in the tender dossier, whose format and instructions must be strictly observed.
