1. Гаранцията за изпълнение на договора е в размер на 3% от стойността на договора за обществена поръчка, без вкл. ДДС. Гаранцията се предоставя в една от формите посочени в чл. 111, ал. 5 от ЗОП и следва да отговаря на изискванията на чл. 111 от ЗОП. Условията за задържане и освобождаване на гаранцията за изпълнение са указани в проекта на договор за изпълнение на обществената поръчка. При представяне на гаранцията във вид на платежно нареждане - паричната сума се внася по сметка на Възложителя (Министерство на здравеопазването):

Когато участникът избере гаранцията за изпълнение да бъде банкова гаранция, тогава тя трябва да бъде безусловна, неотменима със срок на валидност най-малко 60 (шестдесет) дни след изтичане срока на договора и изискуема при първо писмено поискване, в което възложителят заяви, че изпълнителят не е изпълнил задължение по договора за възлагане на обществена поръчка. Когато участникът избере гаранцията за изпълнение да бъде под формата на застраховка, тя трябва да обезпечава изпълнението чрез покритие на отговорността на изпълнителя, със срок на валидност най-малко 60 дни след изтичане на срока на договора. Възложителят следва да бъде посочен като трето ползващо се лице по тази застраховка. Застраховката следва да покрива отговорността на изпълнителя по настоящия договор и не може да бъде използвана за обезпечение на отговорността на изпълнителя по друг договор. Възложителят ще освободи гаранцията за изпълнение, без да дължи лихви за периода, през който средствата законно са престояли при него.

2. Заплащането на стоките по договора се извършва отложено в срок до 30 (тридесетия) ден, след представяне на следните документи: 1) Доставна фактура, съставена съгласно изискванията на ЗДДС и ППЗДДС – оригинал и 2 (два) броя заверени копия; 2) Приемателно-предавателни протоколи по образец на Министерството на здравеопазването, съгласно Приложение № 2 от проекта на договор; 3) Обобщен опис на протоколите – 3 (три) броя; 4) Писмени заявки-разпределения, изготвени от Министерството на здравеопазването и заверени от крайните получатели; 5) Сертификат за освобождаване на всяка партида/сертификат за анализ и съответствие, издаден от квалифицирано лице по ЗЛПХМ – заверено от изпълнителя копие, в превод на български език от фирма, сключила договор с Министерство на външните работи за извършване на официални преводи.

3.Всяка отделна доставка, предмет на договора, следва да бъде доставена в срок до 10 (десет) работни дни след получаване на заявката-разпределение от възложителя и за количествата, точно определени в заявката.

4. Стойностите по отделните обособени позиции са максималния разполагаем финансов ресурс на възложителя и не могат да бъдат надвишавани.

5. Финансирането на настоящата процедура е осигурено частично. На основание чл. 114 от ЗОП, договорите ще се сключват под условие по отношение на количествата, за които не е осигурено финансиране. При сключване на всеки един договор възложителят ще информира писмено изпълнителя, за кои количества не е осигурено финансиране и коя е частта от доставките, която е с отложено изпълнение. В случай, че не бъде осигурено финансиране за доставките, за които изпълнението е отложено, всяка една от страните ще може да поиска съответния договор да бъде, частично прекратен без предизвестие след изтичане на тримесечен срок от сключването му.
