Pravo na žalbu ima svaki gospodarski subjekt koji ima ili je imao pravni interes za dobivanje određenog ugovora o javnoj nabavi, okvirnog sporazuma, dinamičkog sustava nabave ili projektnog natječaja i koji je pretrpio ili bi mogao pretrpjeti štetu od navodnoga kršenja subjektivnih prava. Pravo na žalbu ima i središnje tijelo državne uprave nadležno za politiku javne nabave i nadležno državno odvjetništvo.

Sukladno članku 405. i 406. Zakona o javnoj nabavi (NN 120/16) i Pravilniku o elektroničkoj žalbi u javnoj nabavi (NN 101/17), žalba se izjavljuje Državnoj komisiji za kontrolu postupaka javne nabave, Koturaška cesta 43/IV, 10000 Zagreb u pisanom obliku u roku 10 (deset) dana od dana:

A. objave poziva na nadmetanje u odnosu na sadržaj poziva ili dokumentacije o nabavi;

B. objave obavijesti o ispravku, u odnosu na sadržaj ispravka;

C. objave izmjene dokumentacije o nabavi, u odnosu na sadržaj izmjene dokumentacije;

D. otvaranja ponuda u odnosu na propuštanje naručitelja da valjano odgovori na pravodobno dostavljen zahtjev za dodatne informacije, objašnjenja ili izmjene dodatne dokumentacije o nabavi i na postupak otvaranja ponuda i konačnih ponuda

E. primitka odluke o odabiru ili poništenju, u odnosu na postupak pregleda, ocjene i odabira ponuda, uključujući kriterije za kvalitativni odabir gospodarskog subjekta, ili razloge poništenja

Žalba mora sadržavati najmanje podatke navedene u članku 420. Zakona o javnoj nabavi.

Žalitelj je obvezan primjerak žalbe dostaviti naručitelju u roku za žalbu.

U slučaju izjavljivanja žalbe na dokumentaciju o nabavi ili izmjenu dokumentacije o nabavi, naručitelj će, sukladno članku 419. Zakona o javnoj nabavi, objaviti informaciju da je izjavljena žalba i da se zaustavlja postupak javne nabave.

Žalitelj koji je propustio izjaviti žalbu u određenoj fazi otvorenog postupka javne nabave, nema pravo na žalbu u kasnijoj fazi postupka za prethodnu fazu.
